As the personal representative for my brother's estate, I am managing a property sold to his Homeowners Association (HOA). Ms. Caspari indicated familiarity with both the HOA and its legal counsel, citing a successful litigation against them in the preceding year. Based on this representation, I remitted the requested retainer to Montero Law Group. Subsequently, Ms. Montero advised an additional deposit to cover estimated property taxes and attorney fees. Ms. Caspari asserted that the HOA's attorney had a professional obligation to disclose the precise amount due. I specifically inquired whether my deposit would be refunded if the court's decision was unfavorable. I emphasized that these were personal funds, distinct from the estate, and that Ms. Caspari was aware I was utilizing my own resources to secure this property for my brother's grandson, his next of kin. She confirmed the funds would be returned. Consequently, I deposited the requested amount with Montero Law Group. Subsequently, Ms. Caspari informed me of an unfavorable court ruling. When I sought clarification, she stated the deposited amount was insufficient but did not advise on the required sum. Presently, Ms. Caspari has communicated the judge's decision not to return my deposit, without providing a specific explanation. She suggested engaging my estate attorney to ascertain the reasons for the non-reimbursement of my funds. I remain without clear guidance or resolution, having invested a substantial amount of personal funds with Montero Law Group. I do not recommend retaining this firm.
