My wife of fourteen years, unexpectedly filed for divorce in November, 2019. I was in a state of deep emotional shock and had no idea what to do, only that I had to make some kind of official response within 30 days of receiving the divorce summons. At first, I went into denial and buried my head in the sand, hoping that it was all a mistake and that my wife would eventually come back to me. Luckily, a friend of mine who had gone through a painful divorce the year before, advised me strongly that I should seek legal advice and obtain the services of a family law attorney. Again, I delayed taking any action and it wasn't until my friend badgered me into looking for a divorce lawyer, that I eventually took action. My wife had already hired her attorney and they were taking the initiative in the divorce process and had already assumed that all our joint assets were community property and would be split 50/50. I too assumed that was the case and that there was nothing I could about the situation but go along with their demands. As the deadline for responding drew closer, I eventually started searching around for a lawyer. I called several different attorneys in the Long Beach area and was either met with indifference or just given a rate sheet of hourly charges. I was about to give up when I came upon the website of B. Stuart Walker - www.thebeachlaw.com. After reading through his website, I decided to give it one last try without setting my expectations too high. I phoned his office and after explaining my situation to the paralegal, I was booked in for a 30 minute interview that afternoon with Mr. Walker. I arrived and was met with a cordial welcome by his staff and made to feel at ease. As soon I shook hands with Stuart, I began to feel good about the meeting and proceeded to explain my situation to him. After listening attentively, Stuart asked some searching questions, scratched his head, and said that I may have a different claim to the 50/50 split my wife's attorney was pushing, but I had to act quickly or the case would be resolved in her favor. Stuart sent me off to the Long Beach court house to quickly file a response to the divorce summons whilst he prepared a stipulation that would prevent the sharing of the assets 50/50 until I had more time to submit supporting evidence. After submitting the necessary legal forms, Mr. Walker wrote to my wife's attorney explaining the situation and arguing that I was in fact entitled to 100% of the property assets - my ex wife had conveniently forgotten to tell her lawyer all the relevant facts pertaining to our property. Of course, my wife and her attorney did not accept the basis of my claim and put me through the ringer, but with Stuart's excellent legal counsel and firm guiding hand, I stayed the course and was eventually awarded nearly 90% of the property sale, which was a much greater sum, than if I'd just buckled under and gone along with the initial settlement deal proposed by my wife's attorney. So, the moral of the story is quite simple: 1) if you're about to get involved in divorce proceedings, hire a family law attorney asap, and do what they tell you to do. 2) make sure you find an attorney you trust and have confidence in - you will have to make many painful and hard decisions along the way, and having someone by your side that is both knowledgeable about California family law and understanding of the stress and strain you're going through, is absolutely critical to your long term success (and sanity). 3) make sure you phone around and meet with several lawyers before you commit to one - good personal chemistry is vital. 4) try not to get too emotional about what's happening to you (very difficult I know) and listen carefully to what your lawyer is telling you - California family law has a set of well defined protocols and procedures you must abide by. Do not think you can buck the system and that somehow your case is unique. Take your attorney's advice, even though you may think that you are being hard done by and that the system is unfair. And if you're looking for a family law attorney now, I would highly recommend you give Stuart Walker a call immediately. He is very straightforward, highly professional and honest, and charges a fair rate that will save you money in the long term. Do not go though the divorce process on your own - make sure you have someone like Stuart by your side.
