I Mr. Singh took Andrea Louise Rogers trading as Bramble Hedge Florist, Great Barr, Birmingham to the small claims County Court in Birmingham, as it was my opinion that the service and quality of goods I had received from the merchant after paying approximately £700 for a family funeral was unsatisfactory. The order was placed with the merchant during March 2015 and paid for in advance. The case was heard in November 2015. The defendant failed to attend the court hearing. I Mr. Singh was awarded £490, including costs payable within 14 days of the court order. The merchant has so far has failed to pay the cost awarded, as of to date: 4th January 2016.
On the day of the funeral the flowers arrived approximately an hour late to the family home. The flowers in my opinion and that of my extended family, were of a sub standard quality, also part of the goods received were not as ordered. The merchant in my opinion failed to address my concerns on the day of the funeral when contacted. I therefore ordered additional flowers and made amendments to the display, costing an approximate further £130, to fix in my opinion only some of the faults with the display within the short time frame.
The merchant, in her primary defence, prior the court hearing rejected the claim that the flowers delivered were of a sub-standard quality and that the order was not as per agreed and claimed she had evidence to this effect.
Andrea Louise Rogers, also in her primary defence, prior the court hearing alleged she had been racially abused by the claimant, despite providing no evidence to the courts or to the police to substantiate the alleged racial abuse. The police did not press charges. The district judge at the hearing did not allow the racial abuse allegation. It was also clearly outlined in the Mr. Singh's reply to defence, that he felt that the racial abuse allegation was concocted for the sole purpose to sabotage his claim.
The racial abuse allegation to say the least, has been very upsetting for the claimant and his family at this very emotional time.
The district judge prior to the hearing also ordered the merchant to respond to the issues outlined in Mr. Singh's claim as per the court order dated August 2015. The merchant however failed to respond and was found in contempt of a civil court order by the district county judge.
The owner of the business Andrea Louise Rogers failed to attend the hearing and failed submit the evidence she stated to have, prior to the hearing, either to the courts or the claimant, this was also confirmed by the judge on day of hearing. The judge reviewed the evidence and testimony submitted by the claimant. A C.C.J for the sum of £490, including costs was awarded in favour of Mr. Singh, payable within 14 days of order.
I am still awaiting payment from the Andrea Louise Rogers t/a Bramble Hedge Florist, Great Barr, Birmingham. The entire ordeal at this emotional time has been very upsetting for my family and I.
