Eric Leach represented us in connection with a contemplated purchase of a single family home in Mammoth Lakes. Mr. Leach's brokerage, NextHome, undertook dual representation, with one of the agents under Eric's supervision, representing the sellers. Seller's agent, GIllian Parrish, is also Mr. Leach's live-in girlfriend. We ultimately had to terminate the purchase primarily as the direct result of multiple lies and misrepresentations by Mr. Leach as well as multiple conflicts of interest, disclosure of our confidential information and communications to the other side, harassing and intimidating our mortgage brokers, insurance agents and other professionals working on our behalf, threatening to list the property that we were under purchase contract to buy, delegating his duties and responsibilities to his girlfriend, Ms. Parrish, who is a sellers' agent. Ms. Parrish went as far as to leave a voicemail for our mortgage broker opining on our financial wherewithal to buy the property. Immediately after being hired, Mr. Leach told us he needed to go to Orange County for a week to seek medical care / surgery for serious issues with his neck. While we were sympathetic to his medical condition, instead of seeking medical care to went on a week-long ski trip with no cell or email reception. We would have never hired him had we known that he was going to do that. Mr. Leach further lied about the extent of his anticipated commission on the transaction, a fact that became transparent while escrow was opened. The last straw that caused us to terminate the transaction was an email from Mr. Leach in which he stated "I am having trouble sleeping and waking up with nightmares .... This transaction is having a very negative affect on my mental health." No wonder if you have to manage so many lies, conflicts and breaches of applicable California real estate law and regulations. Under California law, a real estate broker has a fiduciary duty to their client. The broker's fiduciary duty to the client requires the utmost good faith and undivided service and loyalty. Mr. Leach and his brokerage NextHome have breached all such fiduciary duties. Mr. Leach also teaches Jiu-Jitsu at his studio in Mammoth Lakes. Our kids have been attending classes there for six months. The day after we terminated the transaction and fired Mr. Leach, he had our boys expelled from his Jiu Jitsu class. He decided to take out his frustration as a failed, conflicted and unscrupulous real estate agent on little kids. read more
