Our issue is with the specific real estate agent, Kathy Kelly. She is an agent at this business…read morenow, but was with Coldwell Banker in Franklin, MA at the time she was our realtor. She was our agent from Mar '10 to Dec '10 trying to sell our townhouse so we could buy a single-family home. She did not go to many of the showings, but instead only relied on the potential buyers' agents to show the place. We did have two offers (accepted offers), but both were by bad buyers (who basicly got cold feet about buying). After we had the second offer, we put an offer in on a house. At this time, I asked on numerous occassions if we were protected if these buyers backed out and she kept assuring us we were. I just had a bad feeling about these buyers (because we had been through already once before). Well, wouldn't you know it, our buyers backed out. Then the sellers' of the house we were buying decided not to sign the release to get our $1,000 deposit back. Now, Kathy Kelly and her former employer Coldwell Banker - Franklin will not do anything for us even though they did not protect us in the way they wrote the offer. It should have had a contingency to protect us if we did not sell our place. Needless to say we are not happy with Kathy Kelly, our former realtor. We now have a lawyer and are looking into our legal options to get our $1,000 deposit back.
