Joanne F. (if that's who really posted this) is most likely unaware of all the work it takes to manage an HOA for the benefit of all the residents. Like all HOA's, Las Mariposas has Rules and Regulations that were created, and modified over the years, for the benefit and protection of all residents which helps ensure the quality of the neighborhood. The Association encourages "Joanne" to report suspected drug dealers and loud music offenses to the police. The Association has no authority to deal with drug dealers; it is not a law enforcement agency. From time to time the Association has acted on loud music complaints, IF they are witnessed by a Board Member or any "concerned" resident that can identify the source of the music and has the courage to step up and be involved. Window A/C units are prohibited by the Rules & Regulations. If "Joanne" doesn't like that rule, she is certainly free to address the Board at a regular meeting, state her views, and suggest changes. The Association also wants to maintain the neighborhood in nice shape which is another reason the Rules & Regulations exist. As for anyone taking pictures of "Joanne's" property, she lives on a public street and has no expectation of privacy of anyone taking pictures of her property or anyone else's property, as long as it is done from a public place such as a sidewalk or street. One of the continuing problems the Association deals with is owners who fail to make their monthly dues payments on time. Currently, the Association has approximately 20 owners who are behind on their dues, some with as little as $100.00 and several that are $4,000.00 or more. When the Board feels that all other methods of dealing with such owners have failed, it retains an attorney who files liens against the property in the amount of dues owed. If the owner continues to ignore the situation the property could be auctioned at the courthouse steps and the new owner would evict the former owner. The Association currently received payments of over $13,000 for two properties it sued in this manner, and cases are pending on three others. The Association will continue to take such legal action as is necessary. Dues are used to maintain the neighborhood, such as lawn mowing of front yards of 213 homes, sprinkler system maintenance and the water bills for sprinklers in the front yard of all homes, swimming pool maintenance, etc. When owners fail to pay their monthly dues as required they still get these services, which in essence are being paid for by their neighbors.
