When I returned to work after my first surgery, my company put me on a performance improvement plan without regard for me healing from surgery and knowing that I had another surgery coming up. I was distraught, knowing there was likely no way I could make the aggressive deadlines I was given due to my physical condition. I'm so naive, I literally Googled "what to do if your company is trying to fire you due to a condition caused by your job" and of course Worker's Comp came up. I reached out to a few attorneys in the area. One only returned my call after I followed up, and even then, it was a paralegal who told me that they are so busy, they don't really do carpal tunnel work unless you want to pay for it yourself. And of course, I already realized that I wouldn't earn anyone much money since I hadn't lost a limb nor am I permanently disabled. I began researching what to do on my own. Do I file with the state or tell my company first or what? Then I received a return call from Mr. Morrell. He confirmed what the other practice told me, but he also answered my questions and gave me free advice on how to proceed with my company and the state. I literally used his words when I reached out to my HR department. And it protected me from being unfairly fired! If I ever have a more serious worker's comp case or know anyone who does, I will definitely send them to Britton Morrell at Kaplan Morrell. He was kind, patient, and thorough. And he went above and beyond for a non-client! Imagine how much more he puts into his actual clients.

( in a strip mall in Greeley) I ignored all the signals and signs. In The end I got scammed and screwed in my Workman's Comp. Claim. Do the research folks when hiring. Know ALL the fees you will eventually pay (mine totaled 1/2 of settlement amount. This definitely convinced me that Workman's Comp is not for the injured worker but for the company and "legal team" picking up the scraps.

Seriously, if you get hurt at work or if you get an Occupational Disease*, get a lawyer or you'll get screwed. Plus, you really don't want to handle all the massive paperwork yourself. This lawyer is awesome! John Sbarbaro got great results for my husband, and he's a super-nice guy, too. His front office staff are pretty on top of it, even though it might seem like they're blowing you off sometimes when you leave them messages and wish they'd just pick up the phone, be nice and wait your turn like we all learned in kindergarten, haha. And if you're not used to driving in Downtown Denver, be sure to check Waze when you plan your route. Bring change for the meters in case parking is scarce - usually you're fine but hey, it's Denver, always an adventure. ;-p *Lots of employers like to ignore OSHA when it comes to Occupational Disease, and take no steps to protect you. Be aware! Your sore throat/cough could be cancer or silicosis, and your hand falling asleep could actually be hand arm vibration syndrome, thoracic syndrome, cubital tunnel syndrome, carpal tunnel syndrome, or any combination thereof.

I am going on 5 months with out work and nothing has been done by workmans comp for my injury. I was in no way trying to work the system and was completely honest with Dan and his paralegal. I was in the hospital so I did miss an important appointment and subsequently I was told that my case was dismissed by the judge. Being hospitalized was out of my control. I received less than $3000 and wasn't even paid for time lost. In addition my workplace is now saying I quit which is not even close to true. I was told by HR to provide a letter from my Dr. saying I could come back to work without restrictions so I was in the process of doing that. Most recently I was told by my work that they can't speak to me and that I needed to call coporate headquarters. When I asked Dan's paralegal she said I signed and had something noterized saying I quit. The only document I had noterized was to get the lousy settlement. I am not an attorney and spent months sending paperwork to Dan's office, which was a complete waste of time. Some of this does fall on my company and while it is legal for them to fire me it's highly unethical. Slipping paperwork saying I quit was extremely unethical on Dan and his paralegals part. What a joke and waste of my time and energy this was.
