We paid Mr McArdle over $9,000 to recover unpaid commissions under a written employment contract. He is meant to be an accredited specialist in Employment Law. The result: absolutely nothing.
He advised us to pursue an unfair dismissal claim at the Fair Work Commission. The opposing party's own lawyers pointed out in writing that the Fair Work Commission "does not have jurisdiction" over commission claims and called the proceedings "fundamentally misguided." Even Mr McArdle's own colleague - a Special Counsel at the same firm - emailed us strongly recommending that we "discontinue the unfair dismissal claim as soon as possible."
Mr McArdle ignored his own colleague's advice, ignored our requests to stop, and pushed through 5 conciliation conferences over several months. The other side offered zero every single time. He then told us we would need to pay another $15,000 to continue. At our initial consultation, he had assured us the matter would be resolved quickly.
When we questioned his strategy, he rarely responded to our emails. When he did respond, he blamed us for not having "definite proof" of commission - yet in his own email to the opposing lawyer he wrote that their client had been "unambiguously promising commission." He cannot have it both ways.
