Becca Rollins handled two escrow transactions for us as we were originally going to 1031 but then transitioned to paying taxes instead to be able to owner occupied. Every time I emailed I got an answer and when it came to signing everything she was willing to answer any question we had. Our real estate we worked with was a total mess, our lender was also a total mess, but the title company experience went down flawlessly. This was the title company our realtor selected and they were less than helpful. They were very slow to respond to questions. When the wire transfer for the funds from our home sale had been returned, I wasn't informed but had to email the office to see what the hold up was. Only then was I told there had been an issue. I was able to give them more exact wiring instructions and the wire took place the next day, but I have no idea how long the delay would have been if I hadn't asked. The notary they sent to us (we were in a different state) had incorrect information and was basically an idiot (that's the nicest term I can come up with). If I was given the choice to use Kim, I would absolutely without a doubt pick Kim Perry and her team. read more

My mother's estate included a trust for which she was the Trustee. When my mother died, I became the Successor Trustee and I was charged with selling a home belonging to the Trust. When the escrow was opened, I agreed to go with Old Republic Title (ORT). It's a decision I regret making and would advise anyone to avoid repeating. I see NO reason to use this firm for any of my future title transactions. I cannot say if the problems I experienced are with local personnel making the decisions leading to this negative review, or if they were acting upon instructions for a corporate office somewhere. I do know that the process created in me a very strong loathing of all things associated with this company. By the time we closed, I was LIVID over their handling of the escrow process. We started off quite well. The escrow agent wanted to see copies of the trust very early on so that they could address any issues that might arise "at the last minute." While I was initially hesitant to share trust details so early in the process, I nevertheless did so, Upon review of the trust documents, they determined everything was just fine and there were no issues to be addressed. Unfortunately, the sale hit a snag related to the buyers' financing. What was to have been a quick close almost ended up as a lost sale. I had a GREAT real estate agent and she managed to keep everything on track and moving along. We were on pins and needles for a while and, needless to say, there was a high level of stress for everyone. But, the day finally arrived where I was able to go in and sign all the documents necessary to close the sale. Except, several hours later, it turned out there was "one more document" that Old Republic Title insisted I sign. The document was an indemnification agreement naming me personally liable for any liens that might be on the property. All I could think of is "What?????????" They want ME to be responsible for doing THEIR job???? In case I was "missing something," I reached out to my attorney before signing anything. While I haven't (as of this writing) seen the bill from my attorney, I'm guessing it'll be at least $400 as he's not inexpensive and, as it turned out, we ended up playing phone and email tag (more time on his clock). Yet, I figure it was better that then paying ORT's corporate legal fees along with those of any plaintiff who may elect to bring suit, as well as any fines or judgments in the event of a loss of said suit. My attorney's advice? DO NOT SIGN that document. ORT is the one responsible for determining if there were any liens on the property. If none had been filed, then they wouldn't be valid anyway. However, I was told not to sign anything that would indemnify them. I conveyed that message back to ORT and told them that I would not be signing anything indemnifying them from anything associated with any liens. They ended up agreeing to remove the requirement that I sign the lien indemnification, but then added another document they insisted I sign. That document was an Affidavit of No Mortgage or Deed of Trust. While the document did state that "to my knowledge" there were no mortgages or deeds of trust, as a secondary trustee, I couldn't be certain and I wasn't about to get into a legal discussion about if I should have had knowledge or not, etc. Sometimes, it's cheaper for a company to fight that kind of a battle than the "real one." Had I lost that, I might have been forced to pay their legal fees, etc. It was the title company's job, in my opinion, to ascertain that information; not mine! At this point, I reached out to a couple of friends who are in the real estate industry. The two people, agent I know (different geographic area) and a guy who has been a mortgage broker for over 30 years had never even heard of a title company asking for the things ORT was requiring. Both advised me, very strongly, to seek another title company immediately. I decided to reach out to a third person I know, a man who has been investing in real estate for more than the 26 years I've known him. Among his first words to me where "NEVER use ORT! They are a major pain in the [posterior]." This guy was VERY knowledgeable about working with title companies as he's bought and sold a lot of properties over the years. He gave me some good advice. IF I could have withdrawn from the escrow without endangering the sale, I would have done so. In my opinion, a title company should NEVER require a successor trustee to assume liabilities for something the trustee could not be expected to know. I wondered if they would have required a bank, or an attorney to assume the same liabilities where either of those acting as successor trustee? The title company is the one with access to all of the records, not an individual who is just trying to sell a piece of property for an estate. read more
