I've biked the same way for 20+ years and made left turns next to cars all the time. And then one day I was rear-ended while I was preparing to make that same left turn. It's scary that I have no recollection of what happened, one minute I was looking at the green left turn light, the next, I was sideways with my helmet skidding across the asphalt. California CVC 21208 basically states that on a roadway with a bike lane, bicyclists traveling slower than traffic must use the bike lane EXCEPT when making a left turn... With that said, the police report put me at fault!?!?! I was rear ended riding a bike by a car! Really disappointing. Didn't listen to me at all; once he realized that I wasn't going in for surgery wrote me off and useless and not likely to bring him a giant paycheck, and he just phoned it in from there, not even caring that I wasn't getting my actual medical expenses covered. I'm still paying for physical therapy bills. It's been two years and my back still hurts but there's no compensation for the fact that I still refill a script for muscle relaxers and still have to go to physical therapy after long car or plane rides. Spoke to two other lawyers I met later and realized I could've done a lot better. Hell, I could've done better advocating for myself! At least then my medical bills would've been covered! I didn't need to make a giant "pain-and-suffering" profit. Just my actual expenses would've been nice! Totally useless. Only interested in advocating for you if you need surgery and can garner him a substantial financial reward. I wish he's declined my case once he realized I wasn't going to bring him a paycheck instead of effing things up with the insurance company by filing these half-assed claims that didn't actually summarize the full scope of my needed treatment. He sent me to his doctor, and HIS doctor didn't recommend physical therapy because he's a "surgery or you're not worth my time" doctor. And then Corwin told me to not submit MY doctor's prescription for physical therapy and other treatments because it would nullify my case with the insurance company. I don't know what he thought he was protecting. I got nothing from the insurance company in terms of my actual medical treatment and bills. They concluded I had soft-tissue damage, which I do. But without the bills and prescriptions for managing the pain of soft-tissue damage, I couldn't get any of my physical therapy covered.
