I represented myself as the plaintiff in an arbitration case against Comcast. Comcast was…read morerepresented by 3 attorneys from Davis Wright Tremaine out of Washington, DC. Pat Curran was the lead attorney with two other attorneys on his team. I was forced to file a complaint when Comcast deleted my Internet account of 27 years without my request, knowledge or consent. The account contained 27 years worth of emails, contacts, receipts and more. The account email address had also been used to log into over 600 online accounts for myself and my clients. In an instant 27 years was gone and I now needed to figure out how to access what remained.. It took over 2 years of litigation before I learned that the account was deleted due to a software glitch. Comcast admitted early in our proceedings, in writing, that they had made a mistake, without actually acknowledging how the mistake was made. Mr. Curran and his team defended Comcast's actions "mistake" none the less. Their only defense was the exculpatory clause contained in all Comcast subscriber agreements. That clause basically states that no matter what might happen to you or your assets as a result of subscribing to their services, Comcast is not liable ... for anything. In the course of our 2 plus years of mandatory arbitration, Mr. Curran committed numerous violations of professional conduct, including but not limited to; 1) withholding information, 2) making numerous false statements, 3) filing a dispositive motion to vacate using false statements and the wrong applicable state law, 4) making repeated discovery requests that were not only overly burdensome, but irrelevant to the case 5) refusing to go to mediation, in violation of the scheduling order and 6) acting in a discourteous, disrespectful and uncivil manner. Mr. Adam Caldwell, Mr. Curran's team member once wrote to me stating, "I understand you don't like to not get your way, but that's how this works." I did in fact get my way ... I won the case. At the hearing itself, Mr. Curran lost his temper. After the hearing he called to ask if I would be willing to "settle" for 50% of the award in exchange for his not appealing the case to district court. I laughed. He hung up the phone. I am fortunate to be a resident of the State of Colorado, where there is a Supreme Court Ruling which states, "respondent's claim that their subscriber agreement insulates them from culpability is invalid." This information was presented to Comcast's legal team in advance of the hearing, yet they still elected to proceed with a hearing. The claim they lost was that of their breach of the duty of good faith and fair dealing. Why would anyone want to do business with a company that treats their customers like this, especially a customer of 27 years.

I knew that it was fate that brought us together in the first place. Mr. Eagle is genuinely the most honest and trustworthy attorney anyone could have. He is beyond reasonable when it comes to his fees and tries to diffuse things from the start vs. trying to run up higher fees. Opposing counsel was very confrontational and Mr. Eagle never took the bait and remained calm and tried to focus on the best interest of the children from the start. He is passionate at what he does and knows the law inside and out 100%. Unfortunately, even though we tried to settle more than once, my case went to trial. This is where Mr. Eagle really shines. His cross examination was spot on and I was so thankful to have him representing me and what was in the best interests of the children. He was able to have the truth come to light while maintaining honor and integrity in the courtroom which was very important to me. He focused on the law every step of the way from motions to trial briefs to closing arguments and I was so grateful to have him on my side. His office staff is also fabulous and it is always pleasant to speak with them. They are very passionate about their clients as well and very receptive to the clients needs. They are very skilled and familiar with the law and are great to work with. In addition, I loved the fact that it was always so easy to get ahold of Mr. Eagle whenever I needed to and phone calls and emails were always promptly returned. I couldn't have asked for anything more. Keep in mind that this was NOT an easy process and was very stressful at times but Mr. Eagle stood by me 100% and kept me focused on what was best for the children. I can say without a doubt that he will be the only attorney I will ever use for family court matters and I recommend him to anyone (father or mother) who needs excellent representation in a family court issue. My case could be a Lifetime movie and he handled everything with the proper legal knowledge, grace and tried to minimize the conflict every step of the way. You've got yourself a legally binding will, power of attorney, health care advance directive, etc. Betsy also told us everything about death we wouldn't have even known to ask. Plus, she and her husband even come to *your* house for a signing party so you get the documents right away. It wasn't cheap, but check to see if your company has a legal plan (ours paid for almost everything!). But it was thorough, painless, and quick. Just like I hope that impending death of mine will be.
