AVOID THIS FIRM, THE REVIEWS ARE FAKE My husband hired the IDIART firm after a woman had attempted to run him over with her car in a BiMart parking lot. Her car mirror hit his elbow causing a tear in his shoulder muscles. He suffered an injury and much pain from the incident. The entire episode was caught by the store cameras. I was also a witness to the event. The police officer who arrived at the scene issued the woman a citation for reckless driving after watching the store video. Her liability was clear. We were initially impressed after seeing the many positive reviews of the firm. However, it would soon be clear that IDIART did not live up to its reviews. An early warning sign was when we received a letter from them asking us for a positive review of their firm, prior to any resolution of the case. The letter stated, "If you haven't written a review online before, it can be daunting. We are here to help you; so please reach out to us to help you write a positive review." Unfortunately, my husband passed away from a heart attack not long after we retained IDIART, so I was left to deal with IDIART on his behalf. Now, a grieving widow, who had lost her loving husband and only caregiver (I was recovering from a recent brain tumor surgery and am disabled) I was forced to get involved. Looking things over, I saw how my husband had protected me from his growing frustration and consternation with how IDIART was treating him and his case. Right after we retained IDIART, and before my husband's injuries were properly assessed, IDIART sent two ridiculously high settlement offers to the insurer. Both were understandably rejected. Seeing that, I now understood why the insurer continued to fight any settlement of the case, and deny liability, despite having received the store video, and other relevant information. IDIART's initial settlement offers were unprofessional, unsubstantiated and unreasonable. IDIART had initially presented itself as only desiring a quick, profitable settlement before having properly assessed the case. If I were an insurer, I would have ignored them too. Months would pass and I had to demand updates, double check their work, do my own research, provide them copies of things (often multiple times), point out relevant facts about the case they were not giving weight to, and educate them on the law. The only settlement offer they were able to get from the insurer was for $2,300. IDIART insisted numerous times that the case was not worth more than that and suggested I accept the offer. I am not a lawyer but it was clear to me that my husband's injury, the BiMart video, the police report and resulting citation, made the case worth more than $2300 so I refused to accept the offer. IDIART, other than sending ridiculously high settlement offers, did little, if any, real legal work or good-faith negotiation or advocacy on our behalf to get the insurer to a reasonable settlement number. A week before the statute of limitations expired, still advising me to accept the $2300 offer, I had to threaten the filing of a bar complaint to get them to file a civil suit against the driver, which they finally did. I then reviewed everything myself and thought $20,000 would be a fair offer. A few months after filing, I instructed IDIART to send the insurer an offer to settle for $20,000. Guess what? The insurance company countered at $18,500. I instructed IDIART to accept it and the case was settled. As far as I am concerned, without my intervention and pressure, we would not have received a fair settlement. The 30% share of the $18,500 IDIART received was wholly undeserved, and obtained only because I made it happen. They did nothing to earn it. In fact, their money-grubbing behavior and lack of proper representation jeopardized a future settlement. The issues we had with the firm included: no real advocacy on our behalf; not being kept up to date on case progress; several different individuals being assigned to the case, some without a law degree, and often the new person assigned was unaware of relevant facts of the case; constant excuses for their inability to obtain a reasonable and fair settlement offer from the insurer; and constant pressure to settle for a ridiculous sum. I had a bad slip, trip and fall accident I hired Idiart in the beginning they were great although the 2 that were awesome left the firm and I was never told of this change which I should have been considering they were the 2 working on my case. I was told I had a case I had asked what happens if I don't like their offer my attorney Jake said we'll then we sue and take them to court. So they make the demand and the other insurance company say we are not taking liability. So I had said I want to take them to court after all I have a lot of proof it wasn't my fault. Which in the beginning I was go to send in but was told wait to see if we go to court 1st. Then right away Justin Idiart calls me and says I don't have a case and I probably would lose in court. Tells me this 1 year and 8 mths later. There are so so many other things I could point out but this would become a book. They do not keep you updated at all and have so many people working on your case. I thank God found a new attorney that has said he will take it to court. But everything changed when he found out she had NO homeowners insurance. He didn't want to be bothered. No money in it for them. Settled for my Urgent Care visit and stitches.
