I hired James Hartt to represent me against a government agency for violating my human rights as a female with a disability. I hired him for a second case against my employer for retaliation. Both cases were dismissed as NPC. I have a third retaliation case pending with the NYSDHR and will not have Mr. Hartt represent me again. He did very little in either case; albeit the minimum required which was basically copying and pasting my written complaint into legal format. He added very little to the fact finding conference that took place failing to point out anything relevant or pertinent to my case. I was expecting more transparency concerning the scope of an employer's, employer's lawyer's, employee's lawyer's, NYSDHR's, and/or EEOC's investigation. I think each and everyone should have to show her/ his/ their work. Or, each and every case should start at a Hearing. I provided a tremendous amount of information to James D. Hartt. I found out only with the determination letter that Weingarten Rights were "beyond the purview of the NYS Division of Human Rights". I had asked James D. Hartt if EEOC was more appropriate for my case, being Federal, because of the students existing as integral to my workplace/ workspace in the District (whether employment law differentiates the nature of the business yet or not). I had thought James D. Hartt was legally advising NYSDHR because it best suited my case. I also thought, as a lawyer, James D. Hartt knew best when he suggested a focus of perceived sexual orientation with the initial free consultation for wrongful termination. (I'm a never- married, childless woman over 40). I faced adverse reaction to concerns I expressed including co- worker substance abuse, lacking teacher certifications, and needed inclusion qualifications. I learned via open payroll after determination that the pay gap between similarly qualified/ educated coworkers was, in my case, no less than 50K a year. Whether or not this information should have been part of the record or whomever's investigation, James D. Hartt would have known, as evident in the losing case law he applied to my rebuttal to the District trying to drop my case, that he would have to fight the precedent of "similarly situated" as something employers can weaponize to dismiss probable cause for discrimination through demotion or promotion in onboarding justified by employee association guidelines presented to certain employees as if the guidelines were equally put in practice for each and every employee in the business. No client should be re- traumatised by paying for a repeat of a power dynamic that the client was already most vulnerable to and should've been protected from. Agreed? jAMES hARTT ESQ. gave me an $800 refund after he got the whole point of my lawsuit wrong in his response to my ex employer. He did not even try to find out why the NYSDHR didn't even ask one question about my discrimination case. HIRING HIM TO REPRESENT ME WAS THE WORST DECISION I HAVE EVER MADE. I was put in contact with James through the Monroe County Bar Association. James initially listened to what I had to say. In retrospect, it is my opinion that listening was about all James did for my case. He certainly did not help me accurately portray my case with my initial allegations. He had his secretary email me the necessary paperwork in order for me to pay him almost immediately as well as daily for the next three days. My initial confidence was due to the fact that I received no feedback from James at all after I had submitted it back to her, Everything was forwarded on to the Division just as I had written it myself. James did not consult me nor did he make me aware of a rebuttal in which he sent to my old employer and the Division of Human Rights. We did not work on it collaboratively. It is a fact that James had missed my entire point because he did not consult me whenever it was that he prepared it. It is also a fact that James Hartt sent a rebuttal to my old employer as well as the Division that contained factual errors. I was not aware for two whole months after the fact because James neglected to include me when he sent it. It is my opinion that James Hartt neglected my case so badly that his actual representation of me was the catalyst in the decision of The New York State Department of Human Rights to not only issue a no probable cause, they, as James did before them, neglected to ask me even one clarifying question in order to better understand my position. Prior to that, James neglected to respond to several of my inquiries via text or email. On more than one occasion, James mistook me for another client in his responses, My 18 year career as a respected Retail Bank Branch Manager ended abruptly when I stood up for discrimination that happened before my eyes and inside a branch that I managed. It was done by my direct manager toward a member of the team that I managed. I was fired with no reason given right after I reported her conduct to that company's Diversity, Equity and Inclusion department. I have not yet found comparable work in a comparable industry. It is my belief that I won't anytime soon. In my opinion, and as sure as I believe the following statement to be true, it is a fact that hiring James Hartt to represent me is the only thing I regret in my entire life. And, as sure as it is a fact that I believe most lawyers to be scoundrels and generally low life individuals, it is also a fact that Mr. Hartt sent me back $800 of the $3000 I had originally sent to retain his services after I had voiced my opinion that he really didn't do much of anything during his tenure as my counsel. I can only assume that Mr. Hartt tends to agree with my assessment of him being the worst lawyer on earth but I will never truly know what motivated him to issue me a refund in the amount of $800. I can only assume and this isn't the place for assumptions, it is strictly a place for facts. I believe that if Mr. Hartt felt it necessary to send me an unsolicited, partial refund then he must somewhat agree with my very accurate assessment of his services. I also believe that if Mr Hartt saw himself through my eyes that he would refund the rest plus a little bit more because my family deserved a hell of a lot more than what he gave us. We are good people. We deserved so much more than what Mr. Hartt gave us. read more
