(I'm almost positive sometimes shady things were done without our knowledge) And if that wasn't bad enough, Nakamura calls 6 months after the Funeral and tells me I owe him thousands of dollars.....( I know for a fact that everything had already been paid to him in Full!) My dad passed last year and I am now dealing with the sh*tbag mess he made of their house. He broke up the house into 3 deeds before their passing which makes it incredibly difficult for my sisters and I to first of all 1) use these deeds for primary residence if we don't want to pay capital gains taxes and 2) 1031 exchange is a deferral for capital gains, meaning when we do sell the replacement property down the line, if the depreciable cost basis of the property isn't met (we will then pay capital tax gains that were carried over from the original deed of my parents house + the new property. MEANING if he left the house alone, and we acquired the house after they both passed, then we would not have any capital gains taxes, could've sold the house to get properties of our own and my dad would be happy in heaven he took care of us. He allegedly did this for Medicaid purposes, HOWEVER, my mom's income surpasses Medicaid's limits (which I guarantee he knows what Medicaid's income limits are to qualify), so even if we were to dump her assets, she would never qualify for it in the first place. Therefore, he did this whole thing for his own benefit and no one else's. I've hired a new lawyer for some guidance and we're basically stuck with what he did. He said that he would never do this and this is very old school, no one does this anymore. I have no idea how much money this man got for this to extremely complicate people's lives after going through a loss!?! But wow, that's some kind of evil to scam the elderly. While he didn't promise the moon, he did a great sales job and I bought it hook line and sinker. A complicated case (I my mind) and after two years the billable hours have racked up to an enormous debt. Robert eventually dumped me onto Kurt Klein and David- other lawyers in the firm. Each time these hours were posted I said I don't have the fund for this. I repeated this over and over. Oh but you'll win. The win would pay for the hours and everyone would get a nice pay day. Well that didn't happen. They lost in court. And I'm stuck paying a bill that would empty my retirement. I asked if we could come to a smaller amount for the bill. Nope- they won't budge a bit. Stay away from this firm. The talk a good game but in the end you could be out tons of your hard earned cash.
