Later in day, I received call from self-identified law partner Paul Dworak who agreed to assist me. After explaining that I sought a plaintiff's attorney for personal injury, and providing a brief but detailed case summary, Dworak said, curtly, that his law firm wouldn't represent my case. I left all the legal " mumbo-jumbo" to my husband. 18 months later when our house would not sell and it became upside down/ short sale , Bill found us an excellent realtor of short sales and was our closing attorney as well! We met with him a few times but worked primarily via phone (note: every minute on the phone the attorney's $ meter is ticking) I believe we paid him $10,000+ approx ( I found all bill's letters in my husbands desk... Unopened. Bill would call him tell him what we owed, Jon would pay.) Late August September 2015 we met with Bill. He said," I did not work on your debt overall... I did not want to do anything negative to your credit that would adversely affect the sale of your house (accepted an offer late October 2015)." I just listened nodded had no idea in general what was going on-- I had been feverishly packing . ... But we met with him a GOOD year before putting the house on the market......why didn't you call our creditors asap? We were up to date on many, not all. He DID work on just one debt (Winter 2016) with one creditor (they had filed a formal law suit against us) and negotiated them down 1/4-1/3. We met this spring 2016 and I mentioned to him that we were thinking of meeting with Lutheran Family Svces for in-depth financial guidance. He IMMEDIATELY was agitated excited raised his voice ( 1st time ever ) and said, " don't do that! You don't need them you have me." To make a long story short: we DID go to Lutheran Family Svces on Park ave in Minneapolis and got OUTSTANDING advice!!! We also learned from them that Bill had DONE ZERO... that ALL our DEBT was now 100 % charged out!! Zero negotiations zero reduction of debt. Zero promises . We were in TOTAL shock...... This has put us in very grave circumstances. And Lutheran Family Svces could do nothing to help nor save us... Toooo late...... I did indeed call him about a week later, late at night. and left a message stating that Lutheran Family Services offers outstanding assistance-- exactly the kind of guidance I had been fiercely looking for five years.... that they were NO threat to his work for our amt of debt was too high. I did end by saying honestly that he should have guided us to them years ago, for they could have greatly helped us....AND I let him know I was VERY very angry. He IMMEDIATELY dropped us. Once I notified him that I knew he let the statute of limitation pass, he advised me to consult with an attorney regarding the potential malpractice claim I have against him, and informed his malpractice carrier Minnesota Lawyers Mutual (MLM) MLM, refused to discuss settlement of the claim and refused to provide me a decision in writing on the claim. Attorney Gunther as an insured of MLM is also considered an "owner" as MLM is a co-op, and attorneys get kick backs in the form of dividends, when MLM denies a claim no matter how valid, or defends it or settles it for less than it is worth. Before you sign any retainer agreement with any attorney, be sure to search for them on the mars.courts.state.mn.us website first, and look to see what malpractice carrier they have, and review an example policy. Be sure to also look to see if it is a "claims based" or "occurrence based" MLM is also claims based. For claims based policies, if the attorney fails to notify MLM of the claim, and/or intentionally conceals it and does notify MLM, MLM does not have to pay out the claim. Assumes I can read his mind and prepares late. I feel as if he is doesn't have common since, just paid a lot to quote the law. I feel he does not have good communication skills. I feel as if he is a class D attorney. I wouldn't refer Karl to anyone. Karl's assistant Haley has more common knowledge and more helpful then Karl. He would rather reprimand about something I said, instead of trying to understand the message I was trying to explain.
