She also stated that a paid consultation would allow her additional time to address my specific questions regarding waiver strategy, evidence, and presentation.Unfortunately, the initial written assessment I received after the paid consultation was very general and vague, and did not clearly answer any of the four specific questions I had submitted in advance. I had to send a follow-up asking for direct answers and recommendations. To her credit, Ms. Leiva then provided a substantially more specific response. However, I was particularly disappointed by the treatment of the evidence. Considerable attention was given to explaining that my husband's unrelated prior criminal history did not itself establish battery or extreme cruelty -- something I had never suggested. Meanwhile, significant facts that Ms. Leiva herself had identified before the consultation as warranting closer evaluation, including the anger outbursts and post-separation financial/account-related conduct, were not addressed in her final assessment.This was especially concerning to me because the post-separation conduct included identity theft that resulted in debt being created in my name. Whether Ms. Leiva ultimately considered that evidence legally significant or insignificant, I expected it to be analyzed given the stated scope of the consultation and the fact that she had specifically identified this category of conduct beforehand.Ms. Leiva ultimately recommended the good-faith marriage/divorce waiver rather than proceeding now under battery/extreme cruelty, and her follow-up did provide some useful information regarding filing while a divorce is pending. However, overall I did not feel that the consultation reflected a sufficiently careful analysis of the materials I had provided. Based on my experience, I would not retain or recommend this attorney for an I-751 case.
