My attorney only listed one parent on the complaint, according to Georgia statue OSGA 9-11-19, parents that shared joint custody must be included on a complaint. The judge explained to my attorney on the day of the hearing that my complaint was incorrect. My attorney did not ask for a continuance to correct these errors, on the contrary, he argued to have the case heard. As a result of his incompetence and negligence, I was deny visitation. Both attorneys involved with my case have stated that they were hired to complete a" scope of benefits", and this was completed. They refused to take responsibility regarding the loss of my case, the error in the original filing, as well as choosing not to correct said error prior to hearing. They continue to hold up their position, in that they had no control on the ruling of the judge. Where is the logic and that? Ultimately, they were fully aware of the outcome. To confirm my allegations, I had located messages sent from my attorney, Mr. Stewart to his staff on the day of the hearing. He stated " the judge knew he was not going to rule in our favor, yet he made a sit through a 90-minute hearing anyway". Despite these atrocities, they feel like they need feel like they deserve a payment for it. I've paid well over $7,000 for inadequate and incompetent representation from this firm. In my situation, I was having issues with a collector that was harassing my wife and I day and night over the course of years in an effort to try to collect an invalid debt. Even the company to whom I supposedly owed the initial debt to agreed it was erroneous, but the debt had already been sold. In any case I knew my rights but didn't think I had any actual recourse. It got to a point where they started up with their chest-thumping litigious nonsense on an already bad day for me and I retained Mr. Clapp as counsel to put an end to it. Though I initially saw the words "bankruptcy lawyer" and overlooked him, the problem fell within his domain and thus I have absolutely no regrets about hiring him. During our scheduled appointments, he was courteous and professional, and well-versed in all aspects of this particular field of law (credit law? I don't know what it would technically be). Unlike some of the other attornies I talked to, his office didn't look like Saul Goodman's-- it was clean, modern and professional (some places I went to were just dingy and gross-- I don't tolerate sloppiness from someone who might have to represent me in court). Anytime I had a question, he had an answer, or got back to me with one shortly, and even managed to fix a few other minor issues I was having that other attornies I had talked to said was either impossible or something I would have to do on my own.
