Foley pleaded guilty to federal wire fraud affecting a financial institution. According to the Illinois State Bar Association's disciplinary summary, the case involved a purported short-sale transaction concerning property owned by his then-wife. Foley prepared closing documents, concealed that he was effectively the buyer, concealed the true source of the purchase funds, and later prepared a false explanation regarding the earnest money after the transaction was questioned.
