I requested cancellation on July 23, 2026, effective July 22, 2026. The agency confirmed that they submitted the cancellation request to AccessOne80 on July 23. I was then told on August 5 that my refund had been "released." However, I still have not received my refund and its been well over a month since its ''release''. California Insurance Code § 481.5 generally requires unearned premiums for personal-lines insurance, including homeowners insurance, to be tendered within 25 business days after the insurer receives notice of the event generating the refund. Based on the July 23 cancellation notice, that would have been around August 27. I was later told that AccessOne80's accounting department actually mailed check with unused premium on September 3 -- well after the 25-business-day period. I was also told to allow additional time because of the holiday weekend. My concern isn't simply the money owed to me, It's the lack of clear communication and the fact that I was initially told the refund had been "released," only to later learn that the check wasn't actually mailed until September 3. I am also leaving California, so mailing the check to my former California address creates an additional problem if it doesn't arrive before I leave. California Insurance Code § 481.5(d) also provides for 10% annual interest on unearned premiums that are not tendered within the required period, with tender generally considered complete when the payment is deposited in the U.S. mail addressed to the insured's last known address. I specifically asked whether the August 5 "release" constituted legal tender or whether the September 3 mailing date is the applicable date, and whether any interest is owed. Instead of providing a clear answer, I was told that the agency could not speak to AccessOne80's workflow and that I should contact AccessOne80 myself. I filed a complaint with the California Department of Insurance and provided the timeline and correspondence. After notifying the agency that I had filed the complaint, they stopped responding. At this point, I still have not received the refund, and I have not received a clear explanation of when the refund was actually tendered or whether the applicable interest is being paid. I expected much better communication and customer service throughout this process.
