I ended up…read morefiling a grievance against them with the Office of the Disciplinary Counsel for incompetence, disloyalty, fraud, misconduct, not communicating, not getting informed consent, unprofessional behavior, and unsupported charges. The firm did not give me vital information in order to make informed decisions, did not consult, failed to evaluate my case properly, didn't have a strategy, did not fight for me, they argued for the defense, they conducted unauthorized and unnecessary work which they charged against my retainer, they always wanted to discuss things on the phone rather than in emails because they would deny and misrepresent facts after these calls. Based on my experience with this firm it was clear to me that all they wanted is the retainer and simply relayed messages between parties, pushed papers and conducted unnecessary work to justify using up the retainer. Once I started to point these things out, their team suggested I find another law firm, hurting my case even further. I contacted one of their partners with my complaints who ignored every single point I made and evidence I provided and refused to adjust the charges. As such, I filed a suit against them. What I did not know before is that I could have filed a fee dispute instead with the Fee Dispute Resolution Auspices of the Cleveland Metropolitan Bar Association. I would definitely not recommend working with this firm based on my experience.

Mary starts by asking my address. Then she says "so this was work on this house?" I say no it's rental property. She says "Oh what's that address?" I said didn't you get the info I sent through the website? She tells me it doesn't come to her email. Which is fine except she's making the calls from the info. I start to say that doesn't make sense but she tries to talk over the top of me, very rude. The phone number on website goes directly to her. I sent emails, left messages on an Ai recording and almost a week later, I FINALLY spoke to a live person. She made me aware that my submitted application was in progress and awaiting someone on the disability side of things to get my application and work on it from the government side of things. All I want occasionally is a follow up to say they've not forgotten about me. Don't leave me in the wind with absolutely no communication. When I called the intake coordinator at Elk & Elk, she was rude, and said "This is not a case we would take. Do you even know what the survivability rate is for stage 4 lung cancer?" Of course we know. What a thing to say to the wife of someone with stage 4 lung cancer. As if, oh well, his survivability chances are not great, so we won't waste our time. Well, then it is a possible wrongful death lawsuit. Thankfully there are more empathetic, caring firms out there whose coordinators are properly trained to deal with grave illnesses, the people and their caregivers trying to cope with them, and who can see the errors could have been fatal, or still could be, but they were egregious errors, nonetheless. A blast in the face reminding us of how fragile he is, especially after the standard of care was deviated from not once but twice was not at all what we needed. They may be a great law firm for a lot of folks, but the manner in which we were treated when we called about his case was ruthless and did nothing except raise anxiety and fears already present.

I corresponded through their chat feature explaining my entire situation (mother passed away) and was then told they'd forward me to a lawyer. I received a condescending email, text and phone message saying they don't do probate and I need to do a google search and go down the list to find a website that "actually says they do probate" like I'm some kind of idiot. That's a direct quote. Not only was that offensive, but their website explicitly states that they do assist with probate. I chatted with one of their agents via chat for 5 minutes and explained the entire situation -could not that agent have expressed that they don't do probate? I would never recommend this firm based in this experience.
