Despite repeated requests over a period of years beginning in 2011, I have received not one piece of paperwork on what was done with the estate. By law there should be a list of all assets and debts provided: a full accounting is required. Obviously Mr Vivino is aware of the requirements of the law. My son's Audi and his boat were picked up the month after his death. Both were sold and I never was able to get an accounting of the money received. I have no idea of what else was left from my son's estate, if anything. Possibly there was property and of recent information a trust left by his grandfather and other items. Eventually I tried to have the administrator removed. Mr Vivino prepared an agreement for me to sign which, among other items, gave the administrator freedom from responsibility for any actions taken. I had no record of the actions that were taken and was not going to assume all responsibility of actions I knew nothing about. Mr. Vivino's client sent threats about what "his lawyer was going to do to me" as well as what "the judge at the lawyer's office would do to me". Mr Vivino ignored these as well as the pornographic nasty texts his client sent. There was one more matter to take care of, a retirement account of my son's. I sent a copy of the threatening and pornographic texts Mr. Vivino's client had sent me that Mr. Vivino had refused to hear stating "I was not his client". After reading my letter, he agreed to help resolve this with the administrator. I sent Vivino's office all paperwork from the account. I called and was told he was working on it and I should call back. I called back and nothing had been done. Mr. Vivino was rude, impolite, and uninformative. He said to call back in a month. After 6 weeks I called. I called 5 times on 5 different days. Each time I was promised he would return the call. Giving up on the matter I wrote the previous review on YELP. Then Mr Vivino found time to call me back. Not about the issue but to ask if I would remove the review. He also mentioned how much this time was costing and he would be billing the estate. I had hoped this money, if ever recovered, would go to my son's cousins. I want none of it. Seems like everything else it will go to the administrator and Mr. Vivino and I will have NO accounting of anything. All I wanted is the records as required by law. You decide if you wish this man to represent you.

This attorney initially filed a broad case which was to encompass all parties who were responsible for the torture which I endured. However the attorney made some serious errors in his broadscope filing which forced a portion of the case to be lost leaving only wrong doing conducted by some. Despite these errors and my repeated pleas for him to act upon my case he failed to do any work on the file until late 2024. This resulted in one of my witnesses dying without being deposed or getting us wrong statement from them. I have one remaining witness for which this attorney still has not gotten a sworn statement to this day as far as I know. I say as far as I know because this attorney has refused to communicate with me for many many months up until a letter I received in mid-January telling me what he felt like telling me regarding my case but not realizing that the date of his letter was already past the date of the filing deadlines for the submission of important evidence. If it wasn't for another attorney reviewing the case due to this attorney's non-communication I would not have found out about this error. This attorney then scrambled to get the filing deadline extended but at the same time has made clear that he has quit my case and if I communicate with him again he will have me charged with a crime. You will not give up the case to another attorney for any reasonable share of the fee and he will not account for his time which has caused the case to lose valuable remaining time. This attorney is the most unethical person in my opinion that I have ever met who holds the title of officer of the Court. I urge you to look up my Google review of this attorney. I will attempt to attach photos of his deplorable communications to this review. It is already posted on Google. The attached letter is dated January 15th 5 months after this attorney has broken off communication with me and 6 days past the filing deadline for the experts he described needing in this email. Additionally I signed the contingency fee agreement with this attorney were costs would be deducted from the award and this attorney is demanding tens of thousands of dollars from me in order to proceed with the case.
