I am writing this review based on my personal experience and the documents and correspondence from my case. I retained Mr. Foster in May 2023. By August 2025, after approximately two years of representation, I had lost confidence in his handling of my case. During that period, I had only four phone calls and a couple of very short office visits with him. With my Social Security hearing approaching, I still had not been able to sit down with him and meaningfully review my SSA file, the medical evidence, or other documentation I had provided. At our August 5, 2025 meeting, as usual, he was rushed, would not review my file with me, did not allowing me to speak or add additional material to my file, interrupting me and telling me to read his previous emails to prepare for our appeal hearing. I became concerned that he was not sufficiently familiar with my case or prepared for the upcoming hearing. I was concerned enough that I asked whether the hearing should be continued rather than proceeding unprepared. When I asked if the appeal was denied, he stated, "oh well, I don't do appeals". In the end, he rushed me out of his office insisting he had no more time to discuss the case with me. I left angry, disappointed and concerned. On August 12, 2025, I terminated his representation in writing and requested that he waive his fee. I also notified the Social Security hearing office of the termination and explained in writing why I believed I could not proceed with his representation. I requested numerous times for FOSTER to transfer over his work and they responded they do not respond to emails and I needed to set an appointment. After calling to speak to them I was told EVERYTHING they had in my files was provided by ME and so I should already have them. If they where provided by me what work did they do? I was also told not to contact him again or I would be charge with harassment! Luckily, I did find another attorney that actually took the time to review my file and added important fields and details to win my appeal. NOT JAY FOSTER! This attorney IS THE WORST! Mr. Foster's written retainer agreement with me stated that, upon a favorable Social Security decision, his fee would be the lesser of 25% of past-due benefits or $7,200. I have now learned that after the Administrative Law Judge initially disapproved the fee agreement, Mr. Foster challenged that decision and he is asking for $36,0000 from my past-due benefits. What is particularly upsetting to me is that I was not provided with his appeal/request, the amount of the fee he was seeking, or an opportunity to respond before this money was paid. I learned about the request afterward. I am now working through Social Security's process to contest the fee (I'll post an update) I want to be clear that the $36,000 fee is now being disputed. However, anyone thinking of hiring this person should look elsewhere. He is rude, basically puts you on a SSA treadmill, basically places all the work on you and is over billing this claim for monetary gain. I am not claiming what the final outcome will be. I am describing what has occurred in my case as of the date of this review. He claims he fights bad lawyers - Well, maybe you should start in your own office Mr. Foster! Had I known when I hired this firm that he would provide such terrible guidance and representation that I could terminate the representation because I was dissatisfied with the service, hire another attorney to complete my disability case, and later face a claim resulting in approximately $36,000 of my past-due disability benefits being paid to my former attorney, I would have made a very different decision about whom I hired. Anyone considering this firm for a Social Security disability case should carefully read the entire fee agreement, particularly the provisions dealing with termination and attorney fees, and ask exactly what could happen to your past-due benefits if you change attorneys before your case is concluded.

The process started off promising. I explained to her the past dealings I've had with past lawyers that were obviously just looking for a quick buck and didn't want to do any work in return. She told me that we may not win the case but we'd give it a good try (which is all I wanted). As time went on, I noticed that I wasn't getting a return on my investment. The first instance was actually at the beginning. I had to go to the office to ask for a refund because my phone calls or emails were not being returned as it pertained to my case. To my surprise, she had been working on my case, but I wasn't being notified about anything that was going on. She actually helped me win some extra visitation. I was basically getting nothing and she arranged for me to get two full weeks at the end of the summer until the first court case. When we finally got to court, the backlog was so clogged that we got thrown off the docket. That's when we took a turn for the worse. Mrs Luber was so frustrated that she could not figure out the next step. It seemed like she lost her way after that. She told me about a discovery that she would write up to send to the defendant but she never did. She then instructed me to go to the original visitation until the next court case (which was about seven months away at the earliest). In the mean time, there was no contact Mrs Luber and myself, I decided to take matters into my own hands and start writing judges, congressman/congressman, and so on. When Mrs Luber received a copy of a letter I wrote, she decided to drop me as a client. My last dealings with her was in August of 2016. I received a bill in January of 2017 stating that I still owed money. I paid the full amount as soon as I figured out some billing discrepancies with the paralegal but I can not help but feel like I've yet again been ripped off by a lawyer that does the minimum and expects to get paid.
