Apartment was not serviced/cleaned after the previous tenant left. The oven was on, the fridge lined with bleach and not functional, bathrooms had broken toilets, rods, etc, counters and cabinets had a weird white substance all over them. And there was BLACK MOLD on the ceiling! Not to mention we postponed our move twice now because they decided to tear up and replace the floors on move in day.

This fact will be important at the conclusion of the complaint. I had two major issues at the housing complex. The first was when I was displaced from my apartment for 2 months due to a sewer back-up that luminated in my apartment. See attached photos for a visual for the sewer back-up and feces. I had complained to the complex several times about my toilet not flushing properly and even mentioned that I believe there was a back-up somewhere as I would often smell a sewer smell in my apartment. The lack of concern and slow response to rectify the issue caused feces to destroy my bathroom. This was feces from my entire building, not just my apartment. The remedy given to me by the apartment complex was to go through my insurance to be relocated while they fixed the problem. By going through the insurance, I would need to pay a $300 copay. Keep in mind I had just paid my full rent. After complaining several times, the apartment complex agreed for me to reside in the model apartment until my apartment was fixed. This took 2 months! If I had gone through the insurance, they would have only covered 1 month which means me and my daughter would have been on the street if I did not advocate for us. The model apartment had none of the features of my apartment even though I continued to pay full rent while I was displaced. The stove did not work which prompted me to order fast food daily which accumulated a big debt over those 2 months. In addition to being displaced, I was in the final stages of my PhD program preparing for my comprehensive exam. If you know anything about obtaining a doctorate, it is time consuming and quite cumbersome. I experienced major stress because of being displaced from my apartment. I eventually obtained a support animal to help me cope. After 2 months of being displaced, I was able to return to my apartment. I had to throw out clothes and shoes that was damaged. In addition, mold began to appear in my apartment. This is where the foundation of the complaint lies. I had complained for months that I believed mold was in my apartment and was constantly told told it was not. By that time, I was aware that other tenants had the same issue and they either moved from the complex altogether or relocated to another apartment. Finally, the apartment complex had a restoration company come into my apartment to determine if there was mold. I was told by the apartment complex manager, there was no mold in my apartment but that was a lie. I asked several times to see the report from the restoration company and no one provided me with the report. The restoration company completed a treatment in my apartment - if there was no mold or bacteria what did they treat? I was told the treatment was people and animal friendly so while I was at work and my support animals in their cage, the treatment was done in my apartment. Later, when another restoration company came to my apartment, I was told the treatment was not people or animal friendly. This was unacceptable! My support animals were in my apartment at the time. One of them got sick suddenly and I had no clue why. I believe it was because of the treatment. When I told this to the apartment complex, I was told, "oh sorry." After complaining several times about mold, visually seeing mold in my apartment and food (see attached photos) and getting severe migraines I went to my primary doctor. My doctor informed me that the mold could be a big contributing factor to my migraines and requested that I moved from my apartment. I informed the apartment complex of this, and they agreed to allow me out of my lease due to the issues in the apartment causing medical issues. I was also informed by the manager that I would be credited for the food I had to throw out that had mold and bugs in it. I was informed that I would receive a credit for the inconvenience of moving. Upon supplying the apartment complex with the doctors note, videos, and photos I was told they would not credit me anything. I was told I had to still pay full rent up until the day I vacated the property which is not what was originally told to me. I have all the email communications from the property manager about these accommodations. Me and my daughter had to find a new place to live at the last minute. That required me to hire movers (remember I moved to a state where I don't have friends or family), find a new place to live, pay a deposit and first month's rent which was a big strain and not something I had planned for. I moved not because I wanted to, but because I had to. Several tenants also moved out because of mold in their apartments. Some I spoke to personally.
