Where do I begin to extoll the benefits, care, and skill provided by attorney Michelle Roberts? I had an extremely difficult LTD case that involved numerous mental and physical disabilities, an array of physicians, and an employer converted plan where the boundaries between ERISA and NON-ERISA could be debated into eternity. Initially, having successfully filed my own claim without the benefit of counsel, I found myself in a situation where my insurance carrier was determined, by any means necessary, to deny my legitimate LTD claim. This included withholding my monthly payments for almost a full year which nearly led to homelessness (prior to my relocation). Ms. Roberts is one formidable attorney who was pro-active from the start. She was especially effective in filing an appeal which resulted in the reinstatement of my benefits, stayed ahead of the curve by ensuring the LTD carrier received medical reports BEFORE they were even requested, in addition to planning and executing a brilliant strategy to counter the LTD carrier's forced IME. When the LTD carrier, yet again, attempted to deny my claim by sending an egregiously confusing and voluminous report to my physicians, to obtain their agreement with their "expert" IME findings, AND without the courtesy of notifying Ms. Roberts...WOW...this is the bulldog attorney you want hiding in a corner of your home when thieves try to enter. Her swift telephone call to the LTD staff, followed by a devastatingly beautiful succinct correspondence chastising the LTD for refusing to identify what physicians were sent the report, failure to inform us, and their unbelievable refusal to even provide us a copy of the report sent to my physicians, was professional, direct, and as ferocious as any criminal defense litigator's cross-examination (if you've ever worked with one or seen in action). This is the firm you want in your pocket IMMEDIATELY. I strongly urge you, after four+ years of personal experience battling against a top LTD insurance carrier....DO NOT WAIT until your claim is denied or try to navigate the labyrinth of an LTD insurance claim yourself. The insurance [system] is designed to find every way to punish you for having the good sense and foresight to buy an LTD plan in case you are unable to work. The LTD carrier's only concern is their profit line and shareholder bonuses. I appreciated that Ms. Roberts was always direct, even if the news was not so good. Aside from this being a sign of an attorney who holds strong ethical principles, it demonstrated mindfulness and consideration as efficiency is important when you consider the billable costs for an experienced attorney. There is an incredible amount of stress involved when fighting for one's LTD benefits. Having proper legal representation to act on your behalf, while you are ill/disabled and recovering, is invaluable. Ms. Robert's analysis, understanding of LTD laws, and how best to represent her clients is superb. Michelle is a superb advocate, and has represented me since 2009. I was a young professional who was diagnosed with a severe chronic medical condition that made me unable to work. Luckily, I carried personal disability insurance. The company refused to acknowledge my disability and would not pay my benefits. Michelle was able to not only prove my case and successfully instill my benefits, but she also was very caring and personable; making sure that I was I was doing okay, with both the stress of the proceedings as well as my health. After the first year of the disability payments the company paying my benefits was able to challenge that my conditions was not permanent and that I would be able to work for some sort of company, even part time.
