For example, Bishop was supposed to oversee a foundation to provide scholarships for needy students. In the first three years less than $39,000 was awarded to kids while expenses exceeded $365,000. Bishop also "bought" the client's home by taking out a loan from the client's trust, making no down payment, failing to make mortgage payments most of the time, and never a full payment. Then he gave himself two more "loans," but failed to report any of them as required. The Attorney General had to reclaim the property for the trust.

I retained Mr. Flinn to represent me in Napa Superior Court on two pending misdemeanor charges and…read morea violation of misdemeanor probation. I paid him $5000 to represent me. When I asked to pay with a credit card, he charged me an extra $1000 transaction fee. At my arraignment on April 17, 2019, another attorney made a special appearance for Mr. Flinn and continued the case to June 4, 2019. On June 24, Mr. Flinn appeared with me for the first and only time. He continued the case to July 16th and told me the prosecutor was offering 30 days of jail. He advised me that I either had to accept the offer or set the case for trial. He said his fee for the misdemeanor trial was $10,000 that I would have to pay up front, and if the case was settled without a trial he would keep the $10,000 trial fee. Instead I consulted and hired new counsel, who appeared with me on July 16th. I requested that Mr. Flinn refund some of the $6000 I paid him since he had only made one court appearance in my case, but he refused. Mr. Flinn charged me an exorbitant amount for the modest services he performed: $5000 for a single court appearance and a meeting with the prosecutor. Some of that retainer should have been refunded when I chose alternate counsel. Mr. Flinn charged me an additional $1000 transaction fee for using a credit card that is approximately ten times his cost, assuming an accustomed 2% interchange fee. That is usury. His quote of $10,000 for a misdemeanor trial was at least double what other attorneys in the community charge, and keeping the fee if the case settled without trial seems manifestly unfair.
