Initially, I had a different attorney that was recommended to me by a family member. So I started this process blindly with my first choice but after nine months of no progress on my case, I started to look elsewhere. Google comes into the picture, because I ran a google search on the DWI program that my first attorney was hesitant to tell me about and Eric's was in the top 3 in my google search but I really liked his informative website. That was more information on one click that my other attorney never fully explained to me. Then, I called to make an appointment with Mr. Benavides and with a quick five minute phone conversation, I had more information on how to move forward since this whole thing started. At the end of our phone call, I told him I would think about changing over to him but the truth is I pretty much knew right away that this was the best choice for me and my case, I just had to work out how to make the change. So I let go of my other attorney and reluctantly received a fifty percent refund though I could have asked for more and I never looked back. In less than a month (the courts do move slow especially during Covid), Mr. Benavides had my case moving along towards a dismissal. Looking back, I believe the representation I received resulted in an extremely unfavorable outcome that continues to affect my relationship with my children. Since the divorce was finalized, I have consulted with two separate family law firms to evaluate whether a modification of my current custody and visitation order is possible. Both attorneys expressed significant concerns regarding the terms of the decree and visitation schedule that were negotiated and entered in my case. Both advised that a modification appears warranted based on the circumstances. However, one attorney stated that they would explore whether portions of the original order could potentially be thrown out & redone due to how one-sided they believed the agreement to be. The other advised that while they would work to improve the current order, correcting the issues would be difficult because of the terms already in place. What is most frustrating is that I relied on Mr. Longworth's advice when deciding whether to agree to the terms of the settlement. I was led to believe that the provisions were standard and necessary under the circumstances. After obtaining independent legal opinions, I no longer believe that was the case. Divorce and custody cases have long-term consequences that can affect both parents and children for years. Based on my experience, I wish I had sought additional legal opinions before agreeing to the final terms of my decree. However, I feel that we were taken advantage of a bit in terms of billing, and sometimes it even seemed like he withheld communication so I would have to reach out and email, and he would charge us a full half hour--$50 for every email sent, even if it was just a one-sentence email. For example, in telling us about a meeting with the judge, he didn't tell us what time we were scheduled to meet. When I asked a follow up question about when we should plan to meet, he charged us for that! When I asked if we needed to bring any documents to the hearing, he charged us to respond "no." If I hadn't heard from him in a few weeks and just emailed to ask, "Any news?" he would charge us $50 for reading and responding to that email. I just assumed this was standard practice, and after a while I tried to communicate with him as little as possible. But after talking with another lawyer, I learned that it is not normal to charge a full half-hour for quick one-line emails--particularly not for things the lawyer should be telling you proactively! He used up almost all of our retainer for what should have been a very quick, cut-and-dry custody adjustment where all parties agreed to the terms.
