He is a self-employed HVAC technician whose work involves responding to service calls at customers' homes and businesses. Because he does not report to a fixed job site each day, the location of his work changes depending on his customers. During the first surveillance attempt, investigators drove approximately 2.5 hours to conduct surveillance. Despite that significant travel time, the only evidence provided consisted of several low-quality photographs taken within an approximately eight-minute period. The photographs appeared to show him placing what may have been plastic bags into his truck. These images did not establish that he was working, performing HVAC services, meeting with customers, carrying tools or equipment, or lifting more than 20 pounds. The fact that the entire body of evidence consisted of a handful of photographs taken over an eight-minute span is particularly concerning given the purpose of the investigation. I did not hire the company to show that he was present somewhere; I hired them to document evidence relevant to the claims being made in court regarding his employment and physical capabilities. The photographs provided failed to accomplish that objective and offered no meaningful insight into whether he was actively working or capable of performing the physical duties of his profession. The next update I received indicated that a GPS tracker had been placed on his vehicle and that investigators were monitoring his movements and personal activities. However, this was not the service I hired or needed. My objective was specifically to obtain evidence demonstrating that he was performing HVAC work and/or lifting objects in excess of the restrictions he is claiming in court. A GPS tracker can only show where a vehicle travels. His work location changes every day so there will not be any consistent movements. A tracker cannot determine whether someone is working, what activities they are performing, or whether they are lifting more than 20 pounds. As a result, the investigative methods used did not address the purpose for which I retained the company. I paid approximately $1,500 for these services and did not receive evidence that would support the issue being litigated. The surveillance conducted failed to establish whether he was working or physically capable of performing the job duties he claims he cannot perform. They also lacked communication. This was a waste of money.

My SLED complaint against this company is for FAILURE TO PERFORM / BREACH OF CONTRACT. Even if you provide this company with a substantial amount of information and evidence directly related to my case you will not receive desired results. I contracted Bernard Investigations LLC for private investigative and GPS related services and immediately after contracting with Scott Bernard, and paying the retainer fee, there has and was existed NO weekly correspondences with this company, NO GPS tracking updates for the assigned vehicles, and NO direct follow-thru regarding my case from this company to either myself and/or my legal counsel. I was met with one excuse after the other, an excuse after excuse with Investigator Scott Bernard - as to why he was not performing or had no information or reporting to provide to myself and/or my legal counsel as he was directed from week to week. I was consistently meet with short replies from this company owner, work performance inconsistency, and lack of official reports authenticating the work-in-progress for my pre-paid services, as related to my case. Private Investigator Scott Bernard has done and did absolutely nothing related to my case - except to collect a retainer fee and not perform the duties I contracted him to do. This company has ultimately failed to provide any information prior to my pre-existing court case - as he was advised to do so. The only time I received any feedback or correspondence from Private Investigator Scott Bernard, was when I had directly INITIATED the contact, either by email or text message to him from my two cell phone numbers he was provided - in questioning his work-in-progress, and always met with one of MANY excuses he used - (He was in-Court, He was Out of Town for a Wedding, He was Short Staff due to an employee moving out of state, The Battery was going Dead, and followed by the Battery went dead on the GPS unit on the 2007 Infinite and further confirming he had only GPS'd one of the two vehicles I had assigned him). As a result, myself and my legal team, has yet to receive a single work performance report from Mr. Scott Bernard and prior to my first court hearing - as he was instructed to provide. I terminated services with Mr. Scott Bernard, by email, requesting the retainer fee be refunded in full within 10 business days - he told me he had 15 days to get me a report of findings (BUT SAID NOTHING ABOUT MY REFUND REQUEST). I advised over the phone, that those finding terms were unacceptable, as I he was previously requested to report all first investigative findings within 15 days of my initial court hearing scheduled - that which he failed to do, and had met me with yet another excuse of the "GPS was DEAD, and out of service" on the unit, within that time frame.
