I was concerned about this because I don't know of my mother doing anything illegal and why they wouldn't just contact her directly. "Suzanne" said that the government calls relatives to get ahold of the person they are looking for. I repeated that the call SPECIFICALLY asked for my mother, not for me. She would not give me direct answers as to what the legal matter was, how they received my number, and if they already tried to contact my mother. on top of this, they used a Florida number, but claimed to be calling from a county in South Jersey. They called back again today looking for my sister. CID 850-952-9632 They are obviously spoofing numbers they call from. Susan gave me the company name at SMS. She again refused to provide an address. Claims there is a pending case for breach of contract in Pinellas County Florida. Pinellas County has open public records - my sister has NO case ever filed against her. By law, the debt collections has to provide you with proof of debt. Susan refused to send a copy of contract. Claims it is a payday loan never repaid from Jul 2014. My sister has never taken out a pay day loan in her life. ****Everyone do realize that in Florida : In Florida, the statute of limitations for debts, generally, is five years for debts with a written contract and four years for oral agreements. However, there are exceptions, such as a 20-year statute of limitations for court judgments** Again, more proof this is a SCAM. Every state has limitations on statue for collections. A debt collection has to provide you with proof of the debt (signed contract, credit card statements...) and they can't be collecting on an 11 year old debt unless a JUDGMENT had already been granted. These scammers are shameless and have no morals, just trying to steal your money. They have data of old pay day loans and use that data to try and make you think you are being sued by the creditor over unpaid debts. They are stating they are a mediation company on behalf of the county in which your case is being filed. They state collection efforts have been made (which haven't) and a case is moving forward to court if the matter is not settled within 24 hours. They've called family, friends, etc. trying to get a hold of me. They state they'll call your employer and actually said they did however there is no way for them to find my employer's phone number so I know that didn't actually happen. They'll try any scammy tactic, nothing is too low for them. I asked for documentation of the debt/debt verification and all they could provide was a pdf created by them with generic information dated the day we were speaking. They had no details and said any further data would be shown in court. Legally, prior to a case going to court, a legit company would provide you with debt verification and give you 30 days to resolve outside of court. There is also a statute of limitations, the clock starts ticking the day of your first missed payment, outside of statute of limitations, they can still take you to court but it will likely get dismissed if you show that the debt is time barred. Majority of companies will not pursue a time barred debt. I asked very many questions and they either couldn't answer/will be answered in discovery in court or a lot of what they could disclose didn't add up. They stated the loan was taken between 2013-2017 when I was with X employer, however I no longer worked with X employer during that time period. I knew they were a scam but wanted to get as much information as possible to put out here for other people, so I requested a website so that I can confirm their business was legit. After a brief hold, she (Susan Henning is her name) told me that they don't have a website specific to their business but they are affiliated with adr.org. When I spoke to the supervisor (Ray Chadwick) I eventually talked to, he had no idea what that website was until Susan in the background told him. I emailed customer service on adr.org to see if they were in any way affiliated or knew of Strategic Mediations and they confirmed that, no they are not affiliated and anyone who is affiliated will have an email ending in adr.org. They called again last night from a local number (a number which is also associated with scammy debt collection practices according to google) even though they are supposedly located in GA, and stated the case was moving forward. That the recorded calls with me will be used in court and it is now too late to settle the case out of court. This company is a SCAM, They started the call with a threat of court proceeding telling me they were filing a claim against me with a local sheriff's department for a default loan from another state and couldn't give me any dates. I asked for proof via mail because i would not open any links or attachments in a email. i received the email with links that i would not open. They mention bits and pieces of places from your past history to make you think they have a valid record. They actually got enough of my info that they had my family's home number and my dads mobile. That was unacceptable. I did the reverse lookup and the number is listed SCAM. The email i recieve has the name of the company as... Strategic Mediation Services 3330 Northlake pkwy, Atlanta Ga 30345, tel 888.320.8186. I deleted the email from my system, but took screen shot of the letter. I called my lawyer with their information and called my local Sheriffs Department to tell them about it and file a report with them, as well as the BBB and the CFPB. The very rude manager said that it is in a sealed document and she can't give me that info. She then proceeded to say that they are sending it to the court in my area and that I would be served. She says all the info will be in the court document. How can you take me to court without me knowing all the info? I called back and got a James Mitchell, I requested for a supervisor and he stated he was the supervisor then proceeded to get smart, tell me was on the phone for 10 minutes and I corrected him and said I haven't even been talking to him 2 minutes and the call was recorded. He hung up. I then called back and got another lady who refused to give neither her name nor the company name. She then told me they were going to sue me and when I advised I was reporting them to the BBB, CFPB and attorney general she hung up. I then did a reverse lookup on the number they were calling from 941.398.1387 I found the name of the company and address. 1000% a scam. I received two phone calls within the last two days - the first went to voicemail, and they specifically asked for my father, not me. Keep in mind, my father lives in a different state and does not have control over my phone number. They claimed that there was an arbitration against him and that the voicemail served as notice. I knew it was fake, but they didn't actually give a company or agency name in the voicemail. When I spoke to a representative today, I asked for the agency name, then explained that they were asking after my father, not me, and asked what exactly the issue was. I specifically did not give my name when I asked that question. The representative said that my father had two claims against him. When I asked if it was in a court, she said that it would go through Strategic Mediation first, then would be sent to a court. When I asked which court, she stated that she needed to know the name so she could look up the account and which county the claim was filed in. I then said that I had never given his name, so how could she know the claims? She said that most people had two claims against them, so it was just a guess. I then explained that I have a law degree (which I do! I work as a law librarian), and that this was not how mediation worked. She then said, "yes it is ma'am, and he'll have to pay us $3,000", then hung up on me. This is not real. Do not give them your money. This company has called me and my mom using my maiden name and stating that I took out a loan from Cash Net USA in 2012 for $647. They said if I didn't arrange a payment they would send someone to my job and report me to Chex Systems where they would freeze all of my accounts for up to 5 years. Now, I know I had never taken out a loan but I called Cash Net USA anyway to see if they had a record for me. Surprise, surprise! They have NO record of me! Cash Net advised that I report this company and said they were doing the same since they were "acting on behalf" of Cash Net. Someone kept calling my brother, so I called to find out what it was about. They claimed I had some debt from 2010 that they were trying to resolve. Sent some vague email of a cash advance i have never even heard of. The agent put a manager on the line who was rude, raising his voice at me, telling me " you don't want to pay" and just being very loud and rude on the phone. They called and left a message for my daughter and made it sound like it was litigation and that if she didn't call them back, they would forward it to her local authorities and they would proceed with arresting her, I called the number back that they gave me to inquire what this was about because they had left a voicemail. They would only give me so much information but when I googled the number that they gave to us to call back this is when I found the yelp reviews, I do not give them any information and do not work with these people. They are liars, they are thieves. They use unethical methods to get someone to pay money. They use threats and intimidation, and try to frighten people. If they call you, do yourself a favor and consult an attorney be you enter any agreement with them. Make sure you don't trust what they have said verbally, get everything in writing and double check it before you sign anything. One of their tactics is to call relatives and leave messages saying charges have been filed against you and they need you to call them immediately. Then today he called me at work, this time from 302-866-9958, Milford DE. I work for a law firm and one of the attorneys is going to call him back. I'm glad I didn't give them any info.
