Penner's stipulation moved non trust assets into the trust which gave a bias trustee power over them. Because both parties and judge signed the stipulation it became set in stone - could not be modified. The one year statute of limitations on malpractice protects bad attorneys. A WARNING to others DO NOT SIGN anything your attorney asks you to sign - especially if they press you, scare you or hurry you. You have a lot of time to have one or two attorneys read it - there is no rush. So the lesson is to hire a second attorney to watch the first attorney to make sure they don't sabotage your case.

I wanted to open a brokerage account and was told to do it online, no biggie, however the only portal would not let me open a new account. Pretty much got brushed off like they didn't want my business. Called Charles Schwab and opened an account over the phone with the local branch in 5 minutes. Customer services sucks these days, but this was beyond bad.
