You suggested that it is the policy of your business to only perform a mechanical inspection of a summer kitchen because it "is one of those items in a house that contains some structural related items but mostly mechanical related items." Respectfully, this is ludicrous, and I don't believe that you actually believe that. An outdoor kitchen is predominantly structural, and the primary source of the cost of building one is the structure. This is especially true in my case. The outdoor kitchen in question has a grill, mini fridge, and a couple electrical outlets. It will cost me $16,000 to completely replace the outdoor kitchen, excluding appliances. I will leave it to your imagination to determine what it would cost to replace the mini fridge and grill. The structural inspection of a summer kitchen is just as imperative as, if not more than, the mechanical structure. Is it truly your position that despite having a structural engineer present and available to inspect the structure of a summer kitchen, you instruct him not to, per company policy? At the end of the day, Tim, I hired your company to perform an inspection of my home, including the outdoor kitchen. The flammable materials are of no concern to me when the structure itself is caving in because it is completely rotted through. Both your structural and mechanical engineers completely glossed over the actual, and very significant, problem with the outdoor kitchen. This is evidenced by the fact that the recommendation was to "remove/replace flammable materials". I also confirmed with Mr. Selvidge, that only one of your inspectors that day was a structural engineer. On the structural inspection report it shows that Eddy Rodriguez is an engineer. In this case it would make him the structural expert on site. In his report it states, "Miscellaneous Exteriors: Pergola OK The pergola was in generally good condition, with no significant repairs needed." He did not include any pictures from underneath, showing that he did not do a thorough inspection. Replacing one of the pergola posts is an extremely significant repair. Not only should this have been in the report, but this should have been thoroughly discussed in our follow-up meeting. This was not discussed at all. Mr. Mireles performed a substandard inspection of the "summer kitchen". He missed the insulated fire box, and he also missed a hanging electrical box below the grill had he checked it to confirm it was wired properly. I believe Mr. Rodriguez was negligent in his inspection of the structural integrity of the pergola. The pergola was not in safe condition. The negligence is confirmed by you stating, "Concerning the pergola, you are correct in saying that our structural report did not list any deficiencies with the pergola, and we showed several photos of the pergola...One of the posts is shown in your photos as being extensively rotted and it appears the cross sectional area of the supporting wood has been compromised enough to replace the post." In summary, Tim, I believe you know as well as I do that both of your inspectors were grossly negligent in the inspection they performed on my summer kitchen. While I recognize that I cannot force you to be a company of integrity, it is my hope that you will take accountability for the mistakes made in this matter, and that you will work with me to make it right. read more
