When you have tried everything to fix your financial situation, sometimes Chapter 7 is the way to go. My partner and I wrestled with the moral questions of filing bankruptcy and we were also terrified by the actual process of filing and also the outcome post-bankruptcy. We looked at attorneys on Yelp! and we are SO GLAD to have chosen the best attorneys in San Diego to handle this type of case. Lennie and John are two of the nicest, helpful and competent people and that's what you need, in the end, when you go in front of the trustee. So I will start with the steps. Our first step was to call and arrange a meeting with Lennie where we laid out all of our debts and she reviewed them all and even suggested that some IRS past taxes that I owed could be used under Chapter 7. I was completely surprised as I did not know that some IRS past taxes would apply here, but they do. Student Loans do not. Not all of my back taxes applied, but Lennie saved me over $10K alone in back taxes!!! Lennie said we would need to take (2) online courses for a nominal fee. After we completed that, it produced (2) certificates that were automatically applied to our case. These two courses are required by the debtor to take before the case is "discharged." We met Lennie in her office in Point Loma/Rosecrans and she was very sweet. She entered all of assets and debts into the software program that produced our "Claim," that was then automatically filed with the Court. We were done "filing," in an hour. Amazing!!! The next step, three months later is the "trustee" meeting. The trustee is the person who represents the creditors. You meet the trustee downtown in a federal building with other debtors. At this point, we met John Varley, Lennie's partner. He handled the trustee's questions and represented us when it was our turn for the trustee to "hear" our case. He asked two questions and then we were done. While we were waiting to be called, we witnessed other debtors and their attorneys. LET ME BE VERY CLEAR HERE. There are incompetent bankruptcy attorneys out there and we saw a person and their attorney have their whole case thrown out because the attorney did not file it properly. When we were called, we were so grateful that we had John there to back us up competently. And he did. At the end of the three months, our case was ruled by a judge to be "discharged." We are now financially free from over $10K in back taxes and a total of $63K in credit card debt for a grand total of $73K that Lennie and John saved us from paying back. And lastly, ON TOP OF ALL THAT, Lennie gave us a break - she only charged us as 1 person for both of us to declare Chapter 7. Another $1100.00 saved by Lennie. I was making really good money at my previous job. I own my home and also have a rental property. I had some credit card debt but it was still manageable with the income I had coming in. I started a new job in January of 2012 and my pay was cut in half. I started living on my credit cards expecting to be able to pay off the debt at the beginning of 2013 when I received my annual commission check. I was making minimum payments on all my credit cards, my homes, and my car. Unfortunately, I didn't make quota in 2012. My cards were almost maxed out and I was just transferring balances from one card to another to avoid interest and penalty fees. I didn't have a single late payment on my credit but I knew I wasn't going to be able to last another year with the hope of getting a commission check. I found Lennie just in time. I didn't know anything about bankruptcy. I looked online and I knew I made way over the median income to qualify for chapter 7 and I thought I would lose my condo (the only savings/investment I have) in the process.
