I knew it would be a little tricky, since I was traveling, but so is finding another tenant when you're out of the country. I spoke with Sonya Emery, who told me I could get the documents notarized in the US ahead of time and overnight it so it would be in her office for the closing. However, days before closing Nadine Dipaola said that I would need to sign the documents with an attorney in the US over video conference with Nexera. They also decided my wife and I each needed separate legal counsel. To top it all off, they decided I was subject to non-resident taxation (25% withholding) and would need CRA clearance, despite the fact that I live in Toronto and am a permanent resident of Canada. I had been outside of Canada for 18 days at that point, so the idea that I was no longer a resident was certainly news to me. They seem to think that you stop being a resident the moment you step outside the country. Luckily, I was able to find another attorney in Toronto to handle the sale on incredibly short notice. I gave my wife POA for the sale and everything went through fine. It was super simple. I'm not sure what rules Nexera is following, but it doesn't seem to be based on the actual requirements of Ontario law.
