Tom was given explicit wire instructions for payoff of a mortgage on the closing date and unbeknownst to us he decided to FedEx a check over a holiday weekend thus delaying the payoff by 4 days, costing us $1,750 in unnecessary interest. We have closed on more than 6 properties over the years and have never had a check sent via FedEx. When his error was brought to his attention he hid behind a statement that it was the policy of the firm to process the payoff in that manner. When we informed him that we were never informed of their policy (nor had we agreed to it), and reminded him that we had given explicit instructions to wire the funds, he expressed no willingness to accept the error as his. When we requested a refund of our money that he had misappropriated he refused. Nor did he refund his attorney fees. Instead of doing the right thing, he chose to be a jerk and refused. Tom simply put, is not someone worthy of being a fellow Chapel Hill citizen.
