Ken Lonie called me back and claimed he deleted all email communications with his clients. I told him if that were true I'd have to subpoena him personally. He informed me of his intention to not comply with an in person subpoena and said if I did put him on the stand he would claim he didn't remember anything. Maybe some people want an accountant that would obfuscate the legal process, but this is unprofessional and against the code of conduct for the CBA. I have some emails from discovery that show they came from Jeff Brixley as well. So, Mr. Lonie apparently is claiming several of their employees delete emails and records of their clients.
