We were trying to buy a home for our family and it felt at each step of the way, Mark would either not give us the information in a timely manner if at all or he even tried to bully us into signing a non-standard TREC agreement that said we also couldn't review him on yelp, BBB and that his broker and himself wouldn't be liable for lack of disclosure about the foundation or any single item on the sellers disclosure. The house we were trying to buy needed a lot of work and we were never allowed to talk to the previous foundation company for whatever work they actually did on the house. We had 3 people (2 roofers and an inspection person) say the roof needed replacing, but we kept getting letters from Mark's team and roofer that the roof was fine (one letter was 2 years old). After a lot of back and forth, Mark finally worked with his seller to get the insurance adjuster out and surprise, they will replace the roof. At the end of the day, we were offering 10% above asking, an option 5x the norm, and a 5 figure earnest amount, because we were serious. We even offered cash to make the deal go through, but at the end of the day, no closing was scheduled and the transaction didn't happen because we wouldn't release Mark's team and broker of liability for any and all issues that might arise after we buy the house.

The two major issues is the roof and foundation. The roof have severe hail damages and is uninsurable. We have two different roofers and a home inspector telling us the same thing. The roof suffer from severe hail damages and needed to be replace. The agent and seller colluded with a roofing company in providing us with a false report, indicating that the roof is in good condition and suffer no hail damages. As for the foundation, the agent and seller colluded in refusing to provide us with receipt and information on previous foundation work that was done. All around, if you are a buyer, be very wary of anything Mark Cabal provide to you in term of proof that the house is in good condition. Double and triple check everything he give you because more likely than not, he and the seller are being dishonest and providing you with falsified information. If you are a seller, why would you work with someone who is as dishonest as Mark Cabal? If he assist you in offloading a property with issues, be aware that you are still liable for the property when the buyer sue you failure to disclose and blatant fraud. You will have headaches beyond headaches even after the property is sold. Why work with someone like Mark Cabal when he will cause more problem for you in the long run? If you have already bought a property or know of someone who did and had issues, I would encourage you to file a report with TREC to make sure someone like him doesn't practice in real estate again.

You then enter a rent to own agreement with them to purchase the home from them when you are in a financial position to do so. Yes, you will pay more than you would have if you were able to obtain a home loan yourself, but Home Partners of American is an option for people that are tired of apt dwelling, and would like to live in a home, but are not in a position to currently purchase. We set up an appointment with Rosalind for Saturday morning 9:00 am to see 3-4 homes. Not hearing from her, I texted her around 10:00 am to see if we were still on. She informed me that she had sent me an email informing me that she could not work with us after all. Her exact words: " After researching and much collective & great thought, it is with such regret that I must decline entering into an agreement to represent you in the purchase of a home, in conjunction with Home Partners. Their business model is not conducive to my core values and business principles that work in the best interest of my clients. I do apologize. I am sure there is another agent who would be willing to assist you today. Best wishes in your home buying journey." We were technically not her clients. Home Partners of America would have been her clients on our behalf. Home Partners of America requires us to work with a Realtor. The Realtor's job is to take us to see the property. If we find one that we like, the Realtor will let HPA know that we found a home that we liked and submit the offer to Home Partners of America who are the actual buyers. They then purchase the home and we move in. What is not conductive to her core values and business principles concerning this company? This company is a CASH CLIENT. Is CASH against her core values? If so, she needs to find another business. Everyone is out there to make money, and Home Partners of America is becoming one of the fastest Rent to Own businesses out there. They had 1 complaint out of 3 years with the Better Business Bureau and it was resolved. It's no different then someone applying for a credit card or a car loan and their credit is not up to par. Even though they can find someone to grant them the credit they are seeking, they expect to pay a higher interest rate and they are prepared to do so. Is anyone policing them or are the car salesmen telling a customer, I cannot sell you a car because of my core values and business principles. These people are charging you higher interest rates and I don't think it's in your best interest to purchase a car, so I cannot represent you. If every sales person did that, everyone would be out of work. Adults are intelligent enough to make their own decisions, and they don't need a Realtor like Rosalind Booker policing a company who is purchasing a home with CASH on behalf of their clients.
