We had a living room with a super high wall, and ceiling painted, another living room and totally transformed the kitchen with float, tape and retexturizing the walls that had wallpaper covering, we were exhausted after removing the first 2 layers and decided to bite the bullet and call in a professional. Based on one of the neighbor recommendation Ernest Espinoza owners of superior colors LLC, doing business as (DBA) superior painting and remodeling LLC presented himself as having an A+ BBB rating he claimed he licensed and has $2 million in insurance coverage. * On May 23rd 2024, I signed a contract with Ernest Espinoza for exterior painting, following his assurance that the work could be completed in two and a half weeks from signing so I can put my house on the market ASAP. Additionally, I requested an interior painting quote based on my realtor's advice and he promises it will all be done in the same time. * I paid 50% of the exterior painting cost ($7,187.50) and 50% of the interior painting cost ($8,000) via separate checks. * I needed to obtain ACC permission for exterior painting, since he lives in my neighborhood, he knew it will take one and a half weeks put me out of cancellation period. Upon receiving permission, I contacted Ernest Espinoza to schedule the start date, but he provided vague responses between changing the timeline to over a month with no definitive date when he is well aware I need to sell the house ASAP for relocation purposes. * I discovered he is not BBB accredited and has multiple complains for the same incident on BBB When I informed Ernest Espinoza of my intention to file complaints with the BBB and the Attorney General's Consumer Protection Division, he threatened to sue me for defamation and place a mechanic lien on my house even though he never starts work refuse to provide start date or refund. * Despite multiple attempts to resolve the matter, including sending txt messages ,demand letters phone call, house visit and contacting the Bexar County Sheriff's Office, Ernest Espinoza remains unresponsive and refuses to start the work or issue refunds keep saying you will hear from my lawyer in which we never heard from. * Debra Espinoza, Espinoza's wife "a paralegal", admitted in a report to the Sheriff's Office that she was involved in creating the contracts protecting themselves under arbitration clause. She argues her righteous indignation on Facebook justifying the theft and argue the arbitration clause and accused our family of lying. We pursued the matter in civil court, where the judge denied their arbitration request because the contract lacked a start date and failed to include required cancellation instructions--violating Texas Business & Commerce Code Chapter 601. This nullified the arbitration clause, allowing us to move forward with a Deceptive Trade Practices lawsuit and other legal claims. During mediation, Debra and Ernest Espinoza admitted they didn't have the money and couldn't pay it back. Two days later, Ernest was seen painting his multi million dollar house. And this is not an isolated case. Upon public record searches, we found multiple judgments involving the Espinoza family -- including cases brought by a roofer, a school district, and a credit union -- all citing similar patterns of non-payment and breach and victims like us. Please check the Bexar County record. We discovered that this company if forfeited with the secretary of state and their listed LLC physical location is a PO box to avoid accountability. This company is NOT BBB accredited; they lost their legal status which mean they can't represent themselves in court!. We're speaking out to inform and protect others in this community. Stay alert, speak up, and don't let anyone hide behind legal paperwork to exploit trust. I will keep posting update on this case others. What You Can Do If You're a Victim: If you believe you've fallen victim to this scam or similar behavior: 1. Call the Bexar County Sheriff's Office (210) 335-6000 - Request to file a Theft or Theft of Service report. 2. Insist on pressing criminal charges Don't let anyone convince you "it's just a civil matter." If money was taken and no services were delivered, it's theft - and you have the right to pursue it criminally. 3. Get a police report number This creates a formal record and can support a civil case or be submitted to the DA or Attorney General. 4. Connect with other victims There is strength in numbers. Multiple reports showing a pattern of behavior increase the chance of prosecution. He then said he wanted to discuss the project inside our home, which raises security and privacy concerns for my wife and me. I firmly repeated my request that he finish the measurements and send the estimate by email, but he refused. He wanted to enter the house to go over the estimate. Instead, he said, "This is not a good relationship," and left without providing an estimate.
