From that point they did nothing. They didn't help with anything else. Come to find out, Social Security hasn't received any medical records, and the firm didn't notify me or help.. I called every 2-3 weeks to find out what's the next steps, and all they did was say to wait until a decision is returned. No interest, and then when I complained they just withdrew from the case. Avoid using this firm for anything. I also contacted them for a duplicate matter regarding the accident which caused my disability and they were demeaning and rude. Absolutely horrible, and I would NOT recommend anyone use this firm for anything.

I was referred to him by a neighborhood lawyer. I've have served as an expert witness in traumatic spinal injuries for 20 plus years so I am well acquainted with the legal process of litigation. Mr. Schmerler's methods are extremely unorthodox and ineffective! First he attempted to settle my case with the defendant before he even filed a complaint. Then he filed my complaint is the wrong court claiming a phony explanation of process. I had to correct his understanding of the history and events of my claim 5 or 6 times and even then he filed the complaint with multiple serious errors. He litigated at will with no accountability at a Turtle pace failing to respond to motions on time and when the defendants refused to answer interrogatories he refused to contest claiming their responses were irrelevant. It took him 4 months to file my complaint and another six months to get the defendants served. He neglected due process in excess of two years and when I learned that my complaint had been filed inappropriately in Federal Court my statute of limitation had expired. When I challenged his irresponsible performance he resigned and filed a motion to withdraw with me contesting loudly, I contested so loudly the Judge held a hearing to examine the issue. Mr. Schmerler's testimony during that hearing was a pathetic string of lies and denials. Ultimately I was left without legal counsel to fend for myself. I shared my case with over 30 highly acclaimed personal injury attorneys in Austin in search of substitute counsel and was denied representation by every one of them due to the procedural errors Mr. Schmerler perpetrated in my case. My professional and personal opinion of Mr. Schmerler could not be more critical. He is incompetent, arrogant, unprofessional, unethical, and irresponsible. He should be sanctioned for his negligence, that is a matter before the Texas State Bar.
