TLDR: Retained Mr. Muñoz for a $2,000 flat fee covering pretrial work. Before I signed, his office confirmed in writing that the $2,000 covered all pretrial services and that a separate fee would apply only if the case actually proceeded to a jury trial. Near the end of the case, however, he attempted to modify the fee structure, and was told I owed an additional $1,000 at the trial-assignment stage, with another $1,000 for the jury trial itself. I initially retained the office for a $2,000 flat fee. Before I signed, Martiza Muñoz confirmed by email that the $2,000 covered all pretrial work and that a separate invoice would apply only if the case proceeded to a jury trial. This included all pretrial services, discovery, court appearances, settlement negotiations, and closing out any settlement reached before trial. At the beginning, Alberto was generally candid with me about the strengths, weaknesses, and realistic outcomes of the case. He also appeared sympathetic to the fact that this was a family eviction dispute and that I was turning 20 while dealing with it. As the case approached trial, he initially told me that a full jury trial would cost an additional $3,000, but later reduced that amount to $1,000 and also said he would waive the contingency percentage on any move-out settlement because he knew I needed the money. Right before trial, things took a turn for the worst, as he then switched up and told me that a pre-trial assignment (Hearing for Judge selection for a Jury Trial), would cost an extra $1000, with a jury trial being an extra $1000 therefore being charged over the promised amount of $2000 in legal fees. That appeared inconsistent with both his earlier explanation and Maritza's written confirmation that pretrial work was already included in the original $2,000 fee. Waiting for a judge or department assignment was technically pretrial work, especially because no jury had been selected and no trial had begun. I repeatedly asked for written clarification. I also pointed out that the proposed retainer appeared to both include and exclude the jury trial and still contained a $350 hourly-rate provision that had not been clearly explained. Instead of receiving a prompt, straightforward answer, he blew up my phone with constant unnecessary messages and calls attempting to collect it for pre trial work, attempting to coerce/ pressure me into paying extra legal fees when questions remained unanswered, and only after I mentioned Maritza's email, blames me for not answering my calls and continues the case without any extra legal fees. When I chose not to answer the phone because I wanted the discrepancy addressed in writing, Alberto questioned why I was not taking his calls and raised the possibility of substituting out of the case. That made me feel pressured to pay before my questions had been answered. It also felt as though the discrepancy was being treated as my misunderstanding, even though the office's own prior email and Alberto's earlier statements supported my understanding. I also had other problems such as illegally being locked out of my utilities by my ex-landlords husband, which I brought up to Alberto and his legal team, to which I got no responser or follow up. Overall, have he not attempted to cheat me out of my money, especially knowing the situation I was in, gaslight/ treated the discrepancy as though I had misunderstood the agreement for it, and did not respond to several questions or follow up on that issue, nor had the fee terms remained consistent and the communication been handled professionally, I would have rated the office much more highly. Instead, the experience left me disappointed in the office's transparency, professionalism, and integrity.

Despite that, I was advised to accept an agreement that reduced custody and resolved said restraining order, with the explanation that it would make me look better to the court. I followed that advice. In hindsight, it was a serious error. That agreement eliminated the leverage I had and exposed me to renewed conflict later on. When additional issues arose as a direct consequence of that strategy, I was informed that continued representation would require a new and substantial payment. At that point, I was left dealing with the fallout of advice I already regretted, without meaningful support unless I could pay significantly more, which I couldn't afford at that point. The guidance I received showed poor foresight and failed to account for the long-term consequences of surrendering protections that were already in place. In a case involving custody and high conflict, I expected judgment that prioritized stability and protection. That expectation was not met. This ultimately lead to a DVRO against me launched after the agreement was made on numerous false claims and complete loss of custody of my two children. I regret relying on this attorney's advice at a critical moment. Based on my experience, I would not recommend David to anyone who needs careful, long-term advocacy in a family law matter.
