From our very first meeting with Mr Brown, he presented a sense of calm compassion; and was not only helpful from a legal perspective, but also gave my wife and I a stable emotional focus whenever things seemed frightening, hopeless, and upsetting. During that first meeting, Tom Brown gave us a clear understanding of the difficulties of succeeding with a case such as ours, and an accurate perspective regarding the relevant risks. In addition, rather than enlist us as clients immediately, he agreed to advise us as we worked with a third party, independent adjuster (someone who also proved to be a consummate expert - who helped us through our 3-year ordeal. When this adjuster felt the time was right, Mr Brown then began taking action. This process turned out to be exactly the right way to handle things and is the only reason we did not 'lose our shirts'. However, they were able to give me general advice and answer questions that would have taken a lot of time to figure out on my own. Eventually, I had gotten through some of the earlier stages on my own and was near trial - unable to find counsel elsewhere. And, it wasn't just that I couldn't afford Counsel. Sure, that was part of it - but a lot of attorneys I spoke to elsewhere really didn't sound like they were hopeful or knew how to help. Many of the "regular" attorneys I spoke to seemed preoccupied with their fee and, I suspected, may have even been increasing their retainer because I was low income and they wanted assurance of being paid. I get it - everyone should be paid for their services - but I felt like I would be better off spending their retainer on a hotel. LSNV were the only ones who actually listened to my story and understood that I did need help. When they reviewed my case again and were able to take me on. The attorney was incredible; she was highly intelligent, well-organized, reassuring, and quick-thinking. The case for the legal fees went to a Circuit Court of Virginia hearing My lawyer decided not to attend and instead sent a junior partner, Bret Giaimo, whose hands were visibly shaking and voice kept breaking up with nerves. Judge Stoney was clearly not satisfied with the Giaimo's explanation for Jaros' billing practices and awarded me only 70% of my costs as reasonable, leaving me over $11,000 out of pocket. When I asked Jaros to amend his billing to better reflect what the judge determined as reasonable, he refused. Even when I asked him to split the difference he flatly refused. To add insult to inquiry, after the court hearing Jaros sent me a long email telling me that I should look at this as a victory because the defendants were not happy with the amount they had to pay out . He then billed me a further $113 for the 'pleasure' of his email. Overall, I was billed more than $40,000 and was awarded $29,000 by the court as reasonable fees. When I finally reached out to request the refund that is required under Virginia State Bar rules, he tried to gaslight me by suggesting that I was the one who disappeared, despite the clear paper trail showing he had not responded or provided anything at all for over half a year. The combination of total non-communication, no completed agreement, and refusal to return unearned funds is blatantly unethical.
