Three years ago I was a dumb underage kid drinking wine at the beach with friends. I was caught and written up for a open container. I had half a mind to just pay the fee and be over with it, however I had an inkling of an idea that it might not be so simple. I was consulted by David over the repercussions of my action over Avvo, a free legal consulting website. My suspicions were proven true when he responded to my open question that pleading guilty and paying the fine would have resulted in the suspension of my license for a year. At the time I was a working student attending five different colleges and I really needed the mobility of my car to get around. I dropped by Mr. Kestenbaum's office within the week after noticing that it was actually pretty close to where I lived. It came as a shock to me when I was quoted a fee that I knew I could not afford. I was honest with Mr. Kestenbaum about my financial situation and we worked out an agreeable arrangement for his services. David was very thorough over what my options were even prior to obtaining the retainer fee. He was sincere in recommending that I handle the case myself as it was a pretty streamline case that way I would not have to incur a retainer fee. I was probably a nervous train wreck on top of being a nervous kid afraid of public speaking at the time. I knew I could not possibly represent myself coherently to the court and David's legal experience exuded a confidence that seemed very reassuring. David put me at ease in letting me know that he would handle everything. He even clearly knew I was worried about my parents finding out as he told me not to worry because if I was cited for a different reason my house would've already been bombarded with DUI lawyer adverts!! When the court day came Mr. Kestenbaum went ahead and talked to the citing officer when the opportunity was given. David truly worked some magic as the citing officer dropped the charge. The citing officer was not aware that a open bottle ticket issued to a minor would result in my license being suspended. David had me email him my school transcripts and resume that he showed to the citing officer showing that I was a good kid. Not to mention that I took the complete fall for all of my friends when the officer asked who brought the bottle. The icing on the cake? David worked some more magic and asked the clerk to move my hearing as the first one heard. I don't know if I remember correctly but I think the Judge had to ask twice if the officer was dropping the charge as if the initial answer was misheard. I'm sure I must have been the eye of envy of many defendants in the courthouse. I honestly would not be where I am today if I were to have my license suspended. I'm about to graduate from UCSB in June only because I was able to commute to multiple colleges and to and from work. It's really all thanks to David Kestenbaum that I am where I am supposed to be in life. David, upon reading your rebuttal to my initial Yelp review. I feel obligated to address some of your claims. I would be more than happy to meet with you per your offer, but I wonder why you didn't take the initiative to contact me upon reading the review. Also, in addition to meeting with you, I do want this review out there so that potential future clients are aware of my dissatisfaction with your services. ------- I do not believe that I miss characterize our relationship. Whatever I said was based on your actions. I paid you 35K to take on my case based on you're telling me that you are a company trial attorney who has a vast experience. You posted about knowing the top District attorney and made me feel secure in your ability to handle my case. This is the reason I paid that large sum of money. You said that your strategy was to stick with the public defender until the preliminary hearing was over in order to save money, and that you would extend the case as long as possible. You did just that 4-6 months later you told me to hire to trial attorneys for my case. When I said " I thought you were my trial attorney," you said " no I don't do that" that you don't get involved with things like that. But in your Yelp review you said that you have gone to trial 200 times and won 8 of your cases. You then go on to say that you paid a partial amount to the trial attorneys. First off, if this is indeed the case, I would like documented proof of this. Second of all, I ended up paying these trial attorneys 65,000 on top of the 35K that I paid you! Why did I need these travel attorneys in the first place and why did I have to pay for you as well as them to represent me? You said that I agreed to retain these attorneys, but what choice did I have? You had them waiting for me in your office when I was supposed to meet with you. You say that the judge dismissed the motion for continuance you asked for because of your broken foot. Here, I have to say that I saw you walking fine two days before the court date , yet You walked in with crutches on the day of court. I believe the judge knew your reputation of wanting to drag the case on ( which you told me was your strategy) and that's why she refused continuation) and I do agree with the judge. Why couldn't you continue to represent me with a broken foot? How would that affected you from arguing my case. Especially after I have paid you $35,000 to handle it. So when you say I agreed to retain trial attorneys, it is only because I didn't have a choice because you're your actions and decisions. You are the lawyer. That is what I'm paying you for. You still never gave me a breakdown of the time you spent on my case , but you refer to it in your response on my yelp review. -----------------------You told me that the public defenders cross examination was ineffective, but you had told me that was the plan all along. You had told me that the plan was for the PD to mess up and now you say that that's what hurt the case. ------ I also have to bring up an incident in your office when I first met with the trial attorneys. You walked into your office where I was meeting with them and I saw you put an envelope that they have given you in your pocket. Of course I have no proof, I firmly believe they had paid you to refer them to take the case ! I have recently found out this is common practice. Attorney paying other attorneys for referrals. To add more insults these trial attorneys then went on to cut me the same deal with the DA as you had promised me but at an extra cost of $65,000. --------------------------------You say that you've never received a single complaint in 40 years. In my life time, the most important decision I have made was to hire David Kestenbaum law group to handle my Criminal case, the crime I did not commit I was wrongfully arrested by Los Angeles sheriff for using so called counterfeit money and changed by DA for misdemeanor, petty theft.
