I came in by ambulance…read morefrom a domestic violence shelter with severe nausea, vomiting, diarrhea, dangerously low heart rate, low blood pressure, dehydration, and pain near a prior gunshot wound to my head. I had no family with me and nobody there to advocate for me. While I was weak and actively vomiting in the ER, a nurse forcibly held my head down for several minutes. I tried to jerk away because I felt pressure and pain around the bullet wound on my head, but she tightened her grip. The second time I tried to pull away, she moved her hand lower toward the bottom of my head and neck and continued restraining me until I finally pulled away. Then, after my body gave out from the illness and I had diarrhea, another nurse told me that "45 years old is too old to be shitting on yourself." I came to the hospital because I was vomiting and having gastrointestinal distress. Instead of receiving dignity, safety, and compassion, I was physically handled, humiliated, and degraded while sick, alone, and vulnerable. When I requested a supervisor, the house supervisor refused to require an apology and gave excuses about contractors and nurses being straight out of nursing school. A new graduate badge or contractor status does not excuse abusive treatment of a patient. This violated my patient rights under 42 CFR § 482.13, including the right to care in a safe setting, the right to be free from abuse and harassment, the right to be free from improper restraint, and the right to have grievances properly addressed. It violated Texas Administrative Code § 217.12 regarding unprofessional nursing conduct, unsafe practice, and conduct likely to injure or harm a patient. The physical force used against me falls under Texas Penal Code § 22.01 regarding assault and offensive physical contact. This was not healthcare. This was abuse inside a hospital room. I have contacted law enforcement, and Longview police have assured me the names of these nurses will be in the report. I will pursue this through the hospital grievance process, the Texas Board of Nursing, and state and federal healthcare complaint channels as well as the judicial system. This is not the first time these nurses have been abusive because they were too comfortable disrespecting me the entire time. I wasn't the first, but I'm going to spend the next year or two making sure I'm one of the last. I will see you in court.
