I started working with an agent from the Delmar office, looking to purchase a townhouse in Albany…read more He worked very hard on selling me a property, after months of negotiating with the seller, a contract was signed on a listing represented by this same firm and a deposit made. Subsequently the contract was mutually terminated 2/9/20,well before the pandemic closings, due to issues that could not be resolved, there was no dispute on the return of my deposit. After several weeks I inquired about the status of the refund, then a few more weeks of "we're looking into it", finally, over month later, get a message that a check had gone out on 3/16. I responded 3/30 that the address they asked me to confirm was wrong and noted it was not same as on the contract and they should stop the check if possible. On 4/8 I inquired to get an update and they responded that the check had been cashed and just assumed it had gotten to me. I responded back that I had not gotten it and I did not have an acct with the bank it was endorsed to. The next day they message that they confirmed it was deposited "by mistake" by the person who received the misaddressed check. 4/29, I get a message that their bank needs me to return a notarized statement that I did not deposit the check, which i go out in NYC in the middle of the plague to find a notary and return to them. 5/1 the office says it didn't get the form, everyone else that was cc'ed confirmed they did get it. As of today, 5/10/20 I have no check, nor did they confirm they received the 2nd time I submitted the form. I am very understanding that mistakes happen but their customer service stopped the minute I was no longer a client!
