We dropped off our corporate documents and personal tax documents together, each in clearly labeled envelopes. Despite this, the preparer stated she "didn't know" she was supposed to prepare and file the corporate return--something we believe is inconsistent with the facts, given that she had the documents in her possession. Additionally, she is not a CPA, yet there was no required signage at her place of business indicating this. She accepted payment for tax preparation services, and we are now facing more than $3,400 in IRS penalties as a result of the late filing. Based on our experience, taxpayers should be aware that the IRS holds the taxpayer--not the preparer--responsible for penalties, even when the preparer makes an error or oversight.
