I moved in to a one-bedroom, first floor apartment during May 2016. For the first couple of months things were great, however, I noticed on day 1 that dozens upon dozens of cigarette butts were caught in the patio ceiling above me.
I wouldn't normally mind this except for that they would periodically fall onto my patio furniture or directly on my patio. Because I don't believe that people should have to accept having their personal items or space littered with trash and used cigarette butts, especially when they are paying nearly $800 a month for a one-bedroom, I took photos and put in a maintenance request to have these cleaned out.
About a week later, the cigarette filters started appearing in the patio ceiling again. Instead of going to management and potentially creating worse problem, I attempted to handle the situation myself by talking directly with my upstairs neighbor. The response I received from this person was, "It's not intentional, it's just the wind." I offered to buy this person an ash tray, to which this person replied, "Oh, I already have one."
A few days later, more started to accumulate, this time in the grassy area in front of my patio or in the bushes and rocks near my living room window (along with the vomit this same neighbor left on a previous occasion after a long night of drinking).
My next step was to alert the office staff hoping this would get the problem to stop. As a result, notices were left on everyone's doors in the building. Nothing was solved. More of the same notices were posted. Still nothing was solved.
Then, one Saturday morning, I smelled cigarette smoke coming through my bedroom window. I went outside later to walk my dog and found a lit cigarette in the grass in front of my patio.
I took a picture and brought it to the office in person. The office staff told me there was nothing they could really do but that they would let management know. They also said that after they posted the last notice, someone threatened to sue them because they could "throw their cigarette filters wherever they want to." I came to find out later that this was the guy who lived across the hall from me who only smokes in his apartment.
Actually, at least according to the following points in the lease agreement, residents at Pebblebrook aren't allowed to dispose their trash just anywhere. I'm assuming the gentleman didn't care to look this up in the agreement he signed on his own, in which case, I'll make it simple and leave it here for you:
Community Rules:
13. Fire Risk. Store in the Premises or any storage area any material of any kind of description that is combustible, or increases the risk of fire.
14. Litter. Litter or obstruct the public halls or grounds.
16. Throwing Articles. Throw or allow to be thrown, anything out of the windows or doors or down the passages of the building, or from the balconies or patios.
RESIDENTS MUST:
32. Balconies and Patios. Keep apartment balconies and patios free of all personal belongings, except that Resident may maintain lawn furniture theron (provided same is maintained in a neat and orderly manner), and store bicycles when not in use; remove weeds, leaves, trash and other debris.
