Should we really be made to take legal advice on this kind of stuff. The answer is 'no', but they know it will cost us and so we will likely not do, so lets them off the hook. We bought this condo for our daughter through Redfin, Robert Hoyt being the seller. We reside in Washington State, so we very much relied on what our daughter saw in her one visit, our Redfin Agent who was our eyes and ears and Robert Hoyt's professionalism. It turned out that Robert was anything but. His responsiveness to our agents requests for information was like pulling teeth, and he did not seem to value our need for information to meet the closing deadlines. Our Redfin agent was beyond frustrated with Robert Hoyt and we ended up closing with no resolutions. In the current economic climate, we made an hugely over generous offer over asking, did inspection within a week and closed in two. There were a few items picked up by the inspector which we could have asked the seller to correct at their expense, but as they probably did not value more than a $1k, we decided not to jeopardize the sale, however, we made many requests to Robert Hoyt to explain things like switches in kitchen and bathroom that had no purpose, these requests were ignored and with the closing imminent, we unfortunately completed and never got any answers. Our worry is to whether the wires to the none working switches have been safely capped in the cavity wall. We closed two months ago, and as we are out of sight and mind, these requests have never been addressed by Robert Hoyt. Lesson here.... however small, always make seller address the inspectors concerns at their expense. The property listing described the condo as being recently remodeled with 40k of interior upgrades (932 sq ft to include lanai) , which was questionable (white appliances versus stainless, Ikea kitchen, tub liner over existing tub) however, as the Hoyt Company seem to dabble in renovations, it is unclear whether the Hoyt company were commissioned as builder/Hoyt Company/sellers commissioned another builder and who they were. The listing advertised new flooring. Not all floors were new. The old floors did not match the new floors, only in color. After removal of rugs and staging furniture, the old floors were scratched. The appliances were described as 'new' and having 5 year extended warranties but in actuality the appliances (all) were bought by the builder in 2020, so although appeared new, as we took all packaging off from inside of appliances, when registering, they are two years out of five years done. It was also noted in the listing that the sellers redesigned the kitchen which led us to believe that this was was recent due to the recent remodel The new Fridge/Freezer gave the impression of being a higher than average upgrade as it included an ice maker, however after closing found that it was not even plumbed in, and on a wall without a water source, so another expense for us. When we went back to the Hoyt agents regarding the deceptive description on the listing regards a\'Appliance Warranties', their nonchalant reply was 'The appliances did come with a 5 year warranty when purchased, but that they did not need to state on their listing that they were two years into that warranty already'. This speaks volumes to the credibility of Hoyt Agent, Robert Hoyt, and his/their care and responsibility to detail. If you can not trust the listing description for honesty, that is a huge red flag , not only to this agent, but for anyone buying and trusting the description of a listing at all! As stated above, who is going to seek legal advice to get justice at their cost. The listing should be gospel or it is dishonest, and you should be able to claim dishonesty against the realtor at their cost.

They Did not offer any staging advice whatsoever. The pictures from their "photographer" were abysmal. They acted like I was crazy when I complained. They promised new pictures but it never happened. We were also promised a virtual tour and a cd copy. Never happened. A broker open house or something would have been nice, but we received almost no marketing. Other realtors expressed surprise at the lack of marketing for our home. After our house sold, we never heard from them again. I mean, never. You just made a ton of money off us and did no work, the least you could do was write a thank you note. I am pretty sure most real estate agents extend this courtesy when a house sells. There are a ton of real estate agents in Vancouver. Use someone else who might actually do a little work to sell your home.

Even though I TOLD her to out bid everyone else, she delayed the purchase until other papers were signed. She did that on another house, telling me you can only have one bid at a time on home sales in Oregon! The third home I chose, I engaged an other realtor, signed papers with them and then told Heather. She was very upset and would still not look at the house I chose. She kept dragging her feet. I had put earnest money down on a place, $4K which I lost and the Title Company held my check for cash in the amount of $340,000.00 I had to get an attorney (Andrew Teitelman) to get First American Title to return my check. I have no idea what Heather told them. It's been a nightmare! Just now (JUST NOW!!) I found out this home was advertised at 5,000 sq ft and the deed says, 4K sq ft! I am staggered at the complete lack of ethics in Oregon and with John L. Scott and Heather (who, by the way mentioned her church several times so I assume that was so I would think her as being honest.) I don't know if Oregon is just slow in business acumen or fast in dishonesty. I contacted two real estate attorneys who informed me if I were lied to or cheated, it's my fault for not doing due diligence. It's pathetic.
