I was in a car acc 4 yrs ago. Started with Rothenberg, then they referred me to SIMON & SIMON. Communication with them was beyond difficult. I found ALL my own Dr's and directed myself thru the whole process. I documented everything, of which the paralegals, which changed about 6 times, did NOT hand down to each other, but emailed/called me for the information all over again. BTW I suffered a severe concussion, and everything was foggy & difficult, so it would have been nice for S & S to take control. There was NO direction, NO advice. Agreed to a settlement 4 yrs after acc. S & S tells me they are taking 40% AND $4000 in fees. WHAT?? I have a balance w/Medicare(CMS which is a Medicare Recovery) because of all the medical treatments that went above my ins limit. S & S isn't even communicating w/them - it is ME who communicates AND told them the fees that S & S is charging, which brought the balance down. It's BEEN THREE MONTHS SINCE S & S GOT MY SETTLEMENT CHECK FROM DEFENDING INS CO. They owe me $40k. They have stopped communicating w/me. Disappointing does not describe the lack of return calls, lack of representation, and no follow up pertaining to my son's case regarding his May 7, 2019 truck accident. It was determined, without question or doubt, that the driver of the vehicle that ran thru a RED light, hit my son's truck broadside resulting in his truck being totaled. He was taken by ambulance to Leominster Hospital, (Leominster, MA), underwent surgery for bi-lateral tears to the bi-cep in his left arm. He is unable to return to work as a contractor until his arm is strong enough, and when he is able to secure another vehicle. He is being harassed by collection agencies, medical bills, unable to pay rent or buy food. They could at least have the professional decency to contact him to keep him updated and expedite his case since there is NO QUESTION the other driver was at fault and an insurance settlement, in his favor, should be forthcoming! I am a 78 yrs old widow attempting to assist my son with funds to purchase groceries, but this is causing a financial hardship on me, also I live out of State. Simon and Simon is a frayed of big insurance companies such as progressive. If you have a New accident, that reaggravated a previous injury, it may be difficult to prove. I hurt my neck in an accident when I was young 20 treatment I did everything I was supposed to and I was fine it was over 20 years ago I got an accident in August and caught Simon and Simon because after this accident I needed to have surgery like right away and because it happened to be in the same body part that was previously injured they're afraid to take the case I think twice before using Simon and Simon. Found a new lawyer. They will drag your case out to court for the 40% & forget to send you mail for signing paperwork to only find out about it by contacting the insurance company for my lawyer over an accident, which someone hit me head on in my lane and they were positive of marijuana with substances in vehicle. Never been in an accident before but I already know how long everything should take and already from the jump knew what I was getting myself into staying with this firm. Another firm reassured my services needed are being neglected and given no care in the world about or else the work would of met up with the status quo to bring me up to date with everything. I was involved in a rear end collision in 2017. Seriously messed my back up. Having and not knowing I had limited tort (has since been changed!), I turned to S&S at the referral of another attorney who didn't do limited tort cases. They hooked me up with different specialists and docs that did a great job.. I'm still seeing them today even after my case has closed. I didn't have to put a dime out of pocket for anything and S&S took care of me immensely at the conclusion of the case. Certainly more than I expected! After speaking to 2 separate paras and asked very general questions they asked if I could send all my paperwork either via mail or email. I told them yes it may take a few days, it's alot. I was told to wait until I hear back. Then I received another series of calls with more general questions. After 3 days, I receive a voicemail with no explanation that they can't take me on. The team at Simon and Simon who was involved in the lack of representation of my case after I was hit by a car on my bicycle in mid February 2020 deserves less than one star. Not only was I advised by Simon and Simon to take on medical and transportation bills that I did not need including long-term physical therapy and alternative forms of transportation to work (Lyft and Uber), I was then dropped after being contacted less than 3 times with little to no support for more than two months after my accident. I have been in correspondence with the insurance company of the car owner who hit me since my rejection letter from Simon and Simon was sent and the insurance company has yet to receive any paperwork from Simon and Simon stating that they no longer represent me. I finally had to send them the rejection letter myself so that they would talk to me about the case directly. Furthermore, I have been informed by the insurance company that a number of checks were written out to me and sent to Simon and Simon as reparation for the accident. I have yet to see any of these checks and assume that Simon and Simon has been sitting on them without informing me of their actions. I have left voicemails, emails, and texts but have not gotten anything back from anyone. On a whole, I am appalled by the unprofessional and blatantly irresponsible manner in which Simon and Simon has conducted its business. Not only will I never recommend Simon and Simon to anyone who I do not wish to have a terrible legal experience but I can only hope that the reparations issued to me be delivered to me IMMEDIATELY to cover the medical and other expenses that I have accrued. My sister tried calling numerous times- and they never returned her call. Valuable days went by and then we learned in an email that she would be receiving a letter of rejection in the mail and we could download the letter from our email, too. They were rejecting her case after they agreed to take it. They never called her to explain why they were dropping the case...they just dropped it. They took my case and said they were handling my bills as part of my case. They also had me going to the worst physical therapy place I've ever been (comeback physical therapy Worcester ma). After the first visit I said to myself "maybe this is how they build the case because I'd never pay to go here." Even though I was told my medical bills were being handled, they all went to collections because Simon and Simon never contacted them. They never even called the hospitals or ambulance companies until after they were in collections according to each hospital/ambulance company. When I called and emailed, I got not response for days(almost a week). When I finally got a response via phone call, they were gonna send me a letter I had to sign. To my surprise, it was a certified letter saying they were dropping the case 2 months after my hit and run accident. I couldn't believe how Weasley that was. I was on the phone with them and they never mentioned dropping the case. They told me they were sending a form about Insurance for me to sign when it really was a certified letter saying they're dropping my case. I hired them to subpoena the cameras of ma pike in ma to catch the car that ran. Couldn't even do that. I ended up negotiating with bill collectors.
