My concern is what happened after the denial. My MaxCare claim was verbally denied, and despite four written requests, multiple telephone calls, and more than a week of waiting, Fidelity Warranty Services has still not provided me with a written claim determination identifying the contractual basis for its decision or the documentation supporting that decision. Without that information, I cannot meaningfully understand the denial, determine whether it is consistent with my contract, or exercise my contractual rights. My automobile insurance carrier has also requested the warranty documentation, and the lack of a written determination has delayed that process as well. I attempted to resolve this matter directly with FWS before escalating it. Only after my repeated requests went unanswered did I file complaints with the Better Business Bureau, the Ohio Attorney General, the Florida Attorney General, and the Ohio Department of Insurance. If FWS believes its denial is supported by the terms of the contract, then providing the written basis for that decision should be straightforward. As a customer, I believe it is reasonable to expect a company to explain, in writing, why a claim has been denied. I hope no other customer has to spend weeks simply trying to obtain the written explanation of a claim decision. I will never deal with CarMax or any company that works with FWS ever again. My vehicle is in a different shop now than CarMax but two weeks out and I cannot even get work to start on my daughter's Jeep because FWS refuses to give my insurance carrier any written information on the warranty denial--and insurance will not take action without that info--- so this single mother, 100% disabled Veteran, that cannot walk at the moment due to severe foot surgery is left to try and manage this all over the phone and email with absolutely NO response at all from FWS. FWS is absolutely putting my family's job security at risk and it simply is not acceptable. All I want is a written explanation of the denial so my insurance company can move forward. This whole experience is disappointing, disgusting, and disgraceful. FWS should be absolutely ashamed of their company and I pray their loved ones are never placed in this type of situation.
