(Also, despite knowing that we had an impending deadline, he took our retainer and the very next day, went on a 5 day vacation without ever disclosing that he been planning on leaving town for several months.) After getting our retainer back from the first lawyer, we did speak with a couple of other local attorneys regarding our legal problem. They were fine but seemed to be inclined toward escalating the matter instead of looking for a way to resolve it expeditiously and, without great expense. I was fortunate to speak with Ms. Vacura prior to retaining anyone else. Ms. Vacura along with her capable associate, attorney John Rake, offered a sensible option before initiating any aggressive legal action. Now don't misunderstand, this firm is a highly regarded aggressive and successful, litigation firm. Yet, instead of encouraging us to pursue that tact, they offered us a practical option. And it worked! We could not be more pleased. And when it comes to billing, you often DO NOT get what you pay for when it comes to legal representation. He couldn't be bothered to review the information I went to a lot of trouble to provide him and completely disregarded what I told him were my priorities. That's not to say he never worked hard. He worked hard to convince me to let go of things that were extremely important to me (like shared custody of the kids) because he told me they simply weren't going to happen. I realize now that he simply wasn't going to try. And he seemed to have a special gift for finding ways for me to spend extra thousands of dollars (like hiring a CPA to prepare a statement of my premarital net worth) which he then dismissed as useless. All that hard work must have tired him out because he needed to take a bunch of vacations. Most of which just happened to fall the week before some important hearing or deadline. We had one lovely little hearing together, prior to which my ex-wife's lawyer had presented three pages of arguments to the judge. I asked Bob to write up a response and even prepared notes with copies of corresponding evidence to show how each of the statements was demonstrably false. He told me he didn't feel like writing up a response. He said if I wanted one written I'd have to do it myself. Once we were in the hearing, he did nothing more than stand up and sit down when the judge entered and left. I could go on for pages, but you get the idea. My divorce couldn't have been more expensive or painful. You might be able to find a worse lawyer, but you'd probably have to be okay with spending a ton less.

Another bonus was that he took a retainer and used it up before I had to give him more money. That was not the case with other attorneys I had encountered in my research. Many will require the retainer to continually be refilled for any work done weekly or bi-weekly. That can be very difficult if you don't have a ton of available funds and also sometimes your retainer might actually satisfy the entire matter. Mine would have if the other party had responded and didn't drag their feet, which continually added up charges to my bill as we were having to send communications multiple times. He helped me get the case settled outside of court, which would have ended up dragging out the situation much longer and increasing the legal fees tremendously. The only issue I had with anything was with myself and how I should have listened to my gut more when we were doing the negotiation with the retired judge. I came out with an amount that I was satisfied with but I know could have been better if I had not taken such big reductions at the beginning of the negotiation. This was not my lawyer's fault. I agreed to it when we discussed it even though I was doing math in my head thinking this is too much to drop. I am just saying this as advice for anyone going into a settlement.
