On date of signing, I see no sign of the person who handling my case. No explanation whatsoever. No witnesses. Just come and sign the paper and that is it ! Try to request everything from you and expect you to submit within 24 hours before Escrow closes. How professional !!!! Horrible, horrible, horrible !!! Important thing needs to say it thrice. As a part-time real estate agent, I kind of know what steps should be followed and what a GOOD ESCROW officer should help and advise his clients as to if this is the way they want it. He should completely explain to each side what is in the escrow and make sure they understand it. JAMES just seems to skip many steps to wrap up the transaction s soon as possible. This FIRM was asked for by the borrower, so I agreed to them. I shouldn't have done that and used my regular ESCROW. JAMES lacks in DETAILES and fully explaining what each item is and how it affects the paperwork. Is not very professional in how the paperwork is signed and the proper steps in getting " ID " and having both sign at the same time and making sure each party gets the same paperwork.. I got my paper after escrow closed and the other party got hers before. My copies did not even match the borrowers. SOME white-out spaces, some retyping spaces. Not very PROFESSIONAL We should have each gotten copies as we signed them. I think he just wanted to make a QUICK buck on a quick transaction.

My past few transactions, I used the escrow services that my Loan Broker recommends, which is usually an inhouse escrow agent, but this time they had to outsource it. I figured, I've hadn't had a problem with her recommendations before so why not. My broker said this was their first time using Precise Escrow. My escrow agent was James He. The point of having an escrow agent, besides it being the customary practice of having one in a real estate transaction, is for him to handle and obtain the documents necessary to get the transaction completed that is within his ability. I was charged $400 for settlement agent fee, and $100 document preparation fee, $50 for document messenger fee, $20 wire fee, and $175 for Mobile Notary Fee. My frustration is that the services provided should be delivered with good work ethic for the fees. The scheduled closing date was supposed to be a Monday the 13th. The Friday the 10th, before that Monday, James called me asking if I have a contact at AAA (aka my home insurance). He said that he faxed them 2 days prior a request for insurance information and did not get a response. Mind you, this is during the COIVD19 pandemic and most people are not working in the offices, let alone to get faxes; the agents were working remotely (I know because I confirmed with AAA agents that I spoke with over the phone). Generally, time is of the essence in closing escrow. Why did he wait the last day of the week prior to closing to try to get the documents and why did not pick up the phone call earlier to call AAA to get someone on the phone? He even acknowledged that it may talk awhile on hold to reach someone at AAA. Well he did not make the effort. Just pure laziness. If the closing deadline is missed, why would he care, it doesn't affect him, but me! The cosequences of missing a closing date can be $$$ on my end! So I took matters in my own hands to request the necessary documents from AAA. It took me 30 minutes on hold of the 800 number that you can find online. While on the phone with the agent, I was able to have the agent email the PDF document immediately, which I forwarded to James. Why am doing his job that I am paying him to do. His excuse was that he doesn't believe my closing date would be on time because the lender was backed-up due so that's why he wasn't in a rush to get it done. So what. My philosophy is don't give the lender an excuse to say YOU missed the deadline. Instead work like the deadline is a hard deadline so YOU are not the one who can be blamed for missing the deadline. If the lender missed the deadline, then it is on them at least not on the you/me. The lender missed the deadline and extended the closing date because they were backed up. However, my next gripe was that it did not have to be extended much further but for the lack of urgency from James. I get an email from James, the following Friday the 17th, AFTER the initial closing date was extended, indicating he needed another insurance document from AAA. I told him why can't he call AAA (I was busy with my own day job and needed James to handle it for me; that's what I'm paying him for). I get did not get follow-up from him until the next Monday the 20th. Where he emailed me saying he had called AAA that Friday and that the agent he spoke with was suppose to email him the documents. However, he did not get it any documents. Well hello McFly....why don't you immediately follow-up the same day and not wait over the weekend to realize it. Every day I extend the closing date is just extra interest and $$$ that I am paying for at a higher rate. On that same Monday, it took me 5 minutes to get an agent at AAA on the phone and it only took me 10 minutes to get the document from the agent to email it to me, which I subsequently forwarded to James. Clearly, it was not difficult for him to do if he had just put in an ounce of effort. My advice to others you can find better. I have experienced better escrow companies that have provided me with less stress and let me focus on other day job while they handle the services that I am paying them for. If you want to close escrow on time, choose someone else.

We did not discover the seller's name discrepancies until the Grant Deed signing, and it took nearly four hours to review and correct the names and documents. Shortly after, during the buyer's loan document signing, additional issues arose due to multiple unpaid credit cards, which required a loan amount revision and resulted in another four hours of work. Agent: Yoko Kawaguchi (Coldwell Banker Dynasty) Legal strikings: failing to disclose a property defect, breach of duty, misleading client, breach of contract, failing to recommend inspections. Case summary: 1. Initial response from Yoko Kawaguchi dated Oct 12, 2020 on scheduling house tour (while tenant still living in the house). 2. On November 23 (Monday), a Cashier's Check ($5,650) was made out to the Coldwell Banker Dynasty upon Yoko Kawaguchi request on the same day. 3. On November 24 (Tuesday), the MIMO items that I listed were not completed before the 3rd walk through on Tuesday November 24, 2020. "Good evening Ben This is Pamela, I am the potential tenant of 5270 Dewar Ave 90022 I did the walk through with Yoko today and found few things that needed to be fixed. Since the move in date is approaching. I would like these issues be fixed before move in date so these issue will not become issues/affect the rental. - A/C: wall unit is missing. - Front house faucet needed to be put in - Back gate: I would like to remove it, as it shows serious rots from the termites. - Landscaping on the side: please have gardener to clear/trimmed. - Fireplace on court yard: although this is minor, but would appreciate this to be cleaned. ** On November 24 (Wednesday) I asked: Yoko, will you please check the house lock. My understanding was I pay for the new locks (as safety) for $150. But it doesn't look like the locks were changed. Neither as the keys you handed to me." 4. On November 25 (Wednesday), 2020 at 7:49pm, Landlord stated: "Hi Pamela You are asking too much and it is something to digest. I don't wish your request to be a dealbreaker will discuss with my agent and let you know of which parts are doable please do not enter the premises until our Mutual agreement." 5. I was never given permission to re-enter by Yoko nor the landlord prior to my scheduled moving date on the November 29th (Sunday), 2020 as per contract, which I had made all arrangements for: mover, cleaner, utilities, & address change then had no alternatives but to cancel all of the services at last minute. 6. The actions of Yoko and the landlord of the above nullified the contract. 7. I did everything that was asked of me, at the last second. However, this was not the case for Yoko and/or the landlord. Yoko Kawaguchi stated on Nov 30, 2020: Hi Pamela, I've talked to our attorneys already. You've signed the contract fully executed and paid the deposits. Therefore, you are breaching the contract to get out of this. That means landlord is entitled to keep the deposit at this moment till we find the new tenant. Property is already back on market and I'm trying to find the tenant at this moment." On December 3rd (Wednesday) 2020, Yoko said: "I'm going to discuss this matter with (landlord) and our legal dept. I'll get back to you."
