Unethical practice and Code of Conduct WARNING!!!
Agent: Yoko Kawaguchi (Coldwell Banker Dynasty)
Legal strikings: failing to disclose a property defect, breach of duty, misleading client, breach of contract, failing to recommend inspections.
Case summary:
1. Initial response from Yoko Kawaguchi dated Oct 12, 2020 on scheduling house tour (while tenant still living in the house).
2. On November 23 (Monday), a Cashier's Check ($5,650) was made out to the Coldwell Banker Dynasty upon Yoko Kawaguchi request on the same day.
3. On November 24 (Tuesday), the MIMO items that I listed were not completed before the 3rd walk through on Tuesday November 24, 2020.
"Good evening Ben This is Pamela, I am the potential tenant of 5270 Dewar Ave 90022 I did the walk through with Yoko today and found few things that needed to be fixed. Since the move in date is approaching. I would like these issues be fixed before move in date so these issue will not become issues/affect the rental.
- A/C: wall unit is missing.
- Front house faucet needed to be put in
- Back gate: I would like to remove it, as it shows serious rots from the termites.
- Landscaping on the side: please have gardener to clear/trimmed.
- Fireplace on court yard: although this is minor, but would appreciate this to be cleaned.
** On November 24 (Wednesday) I asked: Yoko, will you please check the house lock. My understanding was I pay for the new locks (as safety) for $150. But it doesn't look like the locks were changed. Neither as the keys you handed to me."
4. On November 25 (Wednesday), 2020 at 7:49pm, Landlord stated: "Hi Pamela You are asking too much and it is something to digest. I don't wish your request to be a dealbreaker will discuss with my agent and let you know of which parts are doable please do not enter the premises until our Mutual agreement."
5. I was never given permission to re-enter by Yoko nor the landlord prior to my scheduled moving date on the November 29th (Sunday), 2020 as per contract, which I had made all arrangements for: mover, cleaner, utilities, & address change then had no alternatives but to cancel all of the services at last minute.
6. The actions of Yoko and the landlord of the above nullified the contract.
7. I did everything that was asked of me, at the last second. However, this was not the case for Yoko and/or the landlord.
Yoko Kawaguchi stated on Nov 30, 2020: Hi Pamela, I've talked to our attorneys already. You've signed the contract fully executed and paid the deposits. Therefore, you are breaching the contract to get out of this. That means landlord is entitled to keep the deposit at this moment till we find the new tenant. Property is already back on market and I'm trying to find the tenant at this moment."
On December 3rd (Wednesday) 2020, Yoko said: "I'm going to discuss this matter with (landlord) and our legal dept. I'll get back to you." read more
